12 defendants were prosecuted for the same crime

This morning (April 17), as planned, the Hanoi People's Court will try the case of Violating bidding regulations, causing tens of billions of dong in damage to the State with the defendants including: Mr. Nguyen Quang Tuan (born in 1967, former Director of Hanoi Heart Hospital, former Director of Bach Mai Hospital), Hoang Thi Ngoc Huong (born in 1961, former Deputy Director of Hanoi Heart Hospital), Nguyen Duc Dang (born in 1976, Chairman of the Board of Directors of Hoang Nga Medical Equipment Joint Stock Company), Phan Tuan Dat (born in 1967, former Chairman of the Board of Directors, former Deputy Director of Kim Hoa Phat Biotechnology Joint Stock Company) and 8 other defendants.

The defendants were prosecuted by the Supreme People's Procuracy for the crime of "Violating bidding regulations causing serious consequences" as prescribed in Article 222, Clause 3 - Penal Code.

According to the indictment, Mr. Nguyen Quang Tuan used to hold the role of Director of Hanoi Heart Hospital and Chairman of the Procurement Council. In 2015, Hanoi Heart Hospital collected quotations and prepared to bid for purchasing materials for the whole year of 2016, with a total value of hundreds of billions of VND.

Mr. Nguyen Duc Dang - Chairman of Hoang Nga Company and Phan Tuan Dat - Chairman of Kim Hoa Phat Company, both trade in medical equipment and supplies. Due to "previous acquaintances", they met Mr. Nguyen Quang Tuan. When asked, Mr. Nguyen Quang Tuan agreed to allow Hoang Nga Company and Kim Hoa Phat Company to sell medical equipment and consumables to hospitals, at the unit price proposed by Nguyen Duc Dang and Phan Tuan Dat.

In the period of 2016 - 2017, Hanoi Heart Hospital organized bidding for 5 packages to purchase consumables for cardiovascular intervention, with a total value of more than 595 billion VND. The indictment alleges that during the implementation process, Mr. Tuan and former leaders and staff of the hospital took advantage of their positions and powers to illegally intervene in bidding activities.

As a result, Hoang Nga Company and Kim Hoa Phat Company won a series of bids to supply medical equipment to Hanoi Heart Hospital.

After winning the bid, the prices of the packages were determined to be much higher than the actual price. Specifically, for some packages such as: Pronova drug-coated coronary stents, made by Vascular Concept India, the winning bid price was 36.9 billion VND, but the price according to the valuation conclusion was 17.7 billion VND; Vascular Innovations parachute device, made in Thailand, the winning bid price was 6 billion VND, but the price according to the valuation conclusion was 4.8 billion VND; Vascular Innovations parachute for ventricular septal defect closure, made in Thailand, the winning bid price was 33.8 billion VND, the valuation conclusion was 16.9 billion VND...

The Supreme People's Procuracy determined the total damage in the case to be more than 53 billion VND.

In the testimony of Mr. Nguyen Quang Tuan and Nguyen Duc Dang, it was determined that: On the occasions before Lunar New Year in 2016 and 2017, at the office of the former Director of Hanoi Heart Hospital, Mr. Dang gave Mr. Tuan 10,000 USD to thank him for creating conditions for Hoang Nga Company to win the bid.

Under the direction of Nguyen Quang Tuan, defendant Hoang Thi Ngoc Huong worked with contractors after winning the bid to deduct 2-5% of the bid package value in the form of supporting the hospital with conference, seminar and doctor training costs. Of which, Hoang Nga Company annually supports 300 million VND, these amounts are not accounted for and monitored separately by the Accounting Department.
