At the national online conference on the implementation of the Land, Housing, and Real Estate Business Laws on the afternoon of October 8, Deputy Prime Minister Tran Hong Ha praised Hai Duong as the only province in the country that has fully promulgated the assigned contents with detailed regulations in the three real estate laws.
On the afternoon of October 8, Deputy Prime Minister Tran Hong Ha chaired an online conference of the Government to implement the Laws on Land, Housing, and Real Estate Business.
Attending the conference were leaders and representatives of the Ministries of National Defense, Public Security, Natural Resources and Environment, Construction, Agriculture and Rural Development, Finance, State Bank, Government Office and related ministries, some committees of the National Assembly... along with leaders of 63 provinces and cities at the bridge points.
At Hai Duong bridge point, there were Vice Chairman of Provincial People's Council Nguyen Khac Toan; representatives of leaders of some departments, branches; People's Committees of districts, towns and cities attending.
According to the report of the leaders of the Ministry of Natural Resources and Environment, up to now, 50/63 provinces and cities have issued a number of documents detailing the implementation of the Land Law; however, no locality has issued all legal documents under its authority. Some localities have not issued any documents for implementation. Of the 50/63 provinces and cities that have issued documents, only Hai Duong province has issued all the contents assigned to be detailed in the law. The remaining localities' issued contents are mainly related to compensation, resettlement support, regulations on land allocation limits, recognition of land use rights, conditions for land division and consolidation, etc.
There are 13 provinces and cities that have not issued documents, including Cao Bang, Ninh Binh, Quang Nam, Quang Ngai, Gia Lai, Dak Nong, Tien Giang, Can Tho, Bac Lieu, Ca Mau, Phu Yen, Binh Phuoc and An Giang.
After 2 months of implementation, with the new regulations of the Land Law and documents guiding its implementation, it has initially shown that the new policies have brought about effectiveness such as decentralization, delegation of authority on land use conversion, land recovery, land price determination, issuance of land use right certificates, sea encroachment, etc., which have created consensus among the majority of people, the business community and unity among agencies from the central to local levels, contributing to the liberation of land resources for the country's socio-economic development, accelerating the disbursement of public investment capital.
According to the report of the leaders of the Ministry of Construction, immediately after the 15th National Assembly passed the Housing Law and the Real Estate Business Law, the Prime Minister strongly directed the implementation of these two laws, especially the issuance of detailed regulations.
As of October 7, only 13 localities have issued documents detailing the Housing Law and the Real Estate Business Law, including: Lao Cai, Lai Chau, Bac Ninh, Phu Tho, Yen Bai, Bac Giang, Thai Nguyen, Ha Nam, Hai Duong, Da Nang, Binh Dinh, Tay Ninh, Ca Mau. 50 localities have not yet issued, of which 10 localities have completed the construction and are submitting to the Provincial People's Committee for consideration and promulgation; 40 localities are in the process of construction or are submitting to the Department of Justice for appraisal.
The conference also heard representatives of provinces and cities that were slow in issuing documents detailing the implementation of the three laws report on the causes, difficulties, and obstacles in the slow implementation.
At the conference, Director of the Department of Construction of Hai Duong province Nguyen Hoai Long also reported on the experience in issuing detailed regulations to implement the above three laws. He said that from the very first days of implementing the Land Law, Housing Law and Real Estate Business Law, Hai Duong has identified this as a key task, having a great impact on the socio-economic development of the province. The Provincial People's Committee has directed relevant departments and branches to coordinate closely to ensure the completion of assigned tasks; at the same time, step up propaganda, helping organizations, businesses and people to grasp the new regulations.
The Departments of Construction, Natural Resources and Environment have coordinated to disseminate legal regulations, organize training sessions to improve the capacity of officials and civil servants, and ensure proper implementation of legal regulations. Issue documents with clear deadlines, ensuring progress through streamlined and flexible processes.
Deputy Prime Minister Tran Hong Ha severely criticized the delayed localities, and acknowledged and commended Hai Duong province for its good implementation of the promulgation of documents detailing the implementation of the above three laws. The Deputy Prime Minister requested Hai Duong province to publicize the documents detailing the Land Law, Housing Law, and Real Estate Business Law on its website for other localities to refer to and study.
Concluding the conference, Deputy Prime Minister Tran Hong Ha emphasized that the development and promulgation of documents detailing the implementation of the Land Law, Housing Law, and Real Estate Business Law, which will take effect 5 months in advance, is a practical and urgent requirement to remove difficulties and obstacles, and implement new mechanisms and policies to facilitate socio-economic development and ensure security and national defense. This is also the aspiration of Party committees, authorities, National Assembly delegations, voters, and people of localities.
Along with detailed regulations under the authority of the Government, Prime Minister, ministries and branches, the laws have directly assigned some contents to localities to develop and promulgate simultaneously.
The process of developing decrees and circulars has involved the participation of localities to grasp the contents that need to be issued guiding documents. Therefore, the delay in developing and issuing documents detailing the implementation of the Land Law, Housing Law, and Real Estate Business Law at the local level must assess the level of impact on local economic development, the impact on the interests of organizations and individuals, as well as the responsibilities of relevant agencies.
The Prime Minister's dispatch clearly stated that ministers and heads of sectors must support localities facing difficulties in the process of drafting documents, and therefore must study and seriously implement the Prime Minister's directives.
The Deputy Prime Minister requested local leaders to have a firm grasp of the list of documents to be issued, the situation and progress of implementation; clearly point out shortcomings, limitations, negative impacts and have solutions to overcome them with the spirit of "resolutely producing specific results".
Localities can consider a shortened form when issuing documents that inherit old policies, which have been stipulated in the law; fully implement the processes and procedures for complex documents with great influence and impact.
The two Ministries of Natural Resources and Environment and Construction synthesize the difficulties and problems of localities when drafting regulatory documents to discuss, clarify and resolve.
