According to Article 137 of the 2024 Land Law, households and individuals with one of the following documents will be granted a new certificate of land use rights, house ownership rights and other assets attached to land (red book).
Firstly, people who are using land stably and have documents on land use rights established before October 15, 1993. Have temporary land use right certificates, and have their names in the land registration book and cadastral book.
Second, there are documents on land use rights transfer, purchase and sale of houses attached to land, confirmed by the People's Committee of the commune level to use the land before October 15, 1993.
Third, there are documents established during the land registration process according to Directive 299/TTg dated November 10, 1980, including the minutes of approval confirming the legal land user of the Commune-level Land Registration Council, application for land use rights registration...
Fourth, the house declaration and registration documents are confirmed by the People's Committee at the commune, district/provincial level, with the land area of the house recorded. Documents on house construction and repair are certified and permitted by the People's Committee at the district, provincial level, etc.
Fifth, temporary land allocation papers of the People's Committee at district or provincial level; application for land use approved by the People's Committee at commune level or agricultural cooperative before July 1, 1980 or approved by the People's Committee at district or provincial level.
Sixth, land allocation documents to arrange for cadres and employees to build their own houses/build houses to distribute and grant to cadres and employees with non-budgetary capital, contributed by cadres and employees.
Seventh, other documents before October 15, 1993 as prescribed by the Provincial People's Committee for each locality. Currently using land, with documents from the state-owned agricultural and forestry farms allocating land for house building/house building combined with agricultural production and business establishment before July 1, 2004.
Eighth, people who are using land stably and have legal documents on: Inheritance, donation of land or houses attached to land; documents on handing over houses of love, affection, and great friendship attached to land; documents on liquidation and valuation of houses attached to residential land; documents on purchase of State-owned houses.
Ninth, people who are using land, have documents on land allocation, land lease in accordance with the law before October 15, 1993 until August 1, 2024 but have not been granted a "red book". If the above documents are in the name of another person, there must be documents on the transfer of land use rights but before August 1, 2024, the procedures for transferring land use rights have not been completed and there is no dispute.
If people have lost the above documents and the State agency no longer keeps them, they must have confirmation of stable land use and no disputes from the People's Committee at the commune level.
