The Ministry of Education and Training prohibits teachers from tutoring their own students.

Responding to the petition of Quang Binh voters regarding extra teaching and learning, Minister of Education and Training Nguyen Kim Son emphasized that since 2012, the Ministry of Education and Training has issued Circular No. 17 regulating and guiding this matter.

Accordingly, extra teaching and learning activities must ensure basic principles. Firstly, extra teaching and learning classes must not be organized according to regular classes. Secondly, students in the same extra teaching and learning class must have equivalent academic ability. When placing students in extra teaching and learning classes, it must be based on the students' academic ability.

Third, absolutely do not cut down on the content of the regular general education program to include it in extra classes. Fourth, do not teach extra classes ahead of time that are in the regular general education program.

The Ministry of Education and Training also clearly stipulates that the subjects of extra classes are students who have the need to take extra classes, voluntarily take extra classes and have the consent of their families. Teachers are not allowed to use any form of coercion to force students and their families to take extra classes. Extra teaching and learning activities must contribute to consolidating and improving knowledge and skills, be suitable for the psychological characteristics and not cause a situation that exceeds the students' ability to absorb.

Circular 17 also clearly stipulates cases where extra teaching and learning are not allowed. Firstly, no extra teaching is allowed for students whose schools have organized two sessions per day. Secondly, no extra teaching is allowed for primary school students, except in cases of training in arts, sports, and life skills.

Third, teachers receiving salaries from the salary fund of public service units are not allowed to teach extra classes outside of school or teach their own students without the permission of the head of the agency managing that teacher.

According to the Minister of Education and Training, the provincial People's Committee is responsible for managing extra teaching and learning activities in the area; issuing documents regulating extra teaching and learning in the area. At the same time, the responsibility of the Department of Education and Training is to be the focal agency to regularly urge and inspect the implementation of this regulation. The Department will be responsible to the provincial People's Committee for managing extra teaching and learning activities in the area according to regulations.

Most recently, the Ministry also issued Circular 32 of 2020 to provide more detailed regulations on extra teaching and learning activities in schools. In the coming time, the Ministry of Education and Training will continue to advise the Government to propose to the National Assembly to include extra teaching and learning activities in the list of conditional business lines.
