Ministry of Health requests to step up inspection and punishment related to electronic cigarettes

On January 23, the Ministry of Health informed that it had sent an official dispatch to the Ministry of Information and Communications and the Ministry of Education and Training on strengthening the implementation of Resolution No. 173/2024/QH15 of the National Assembly on banning the production, trading, import, storage, transportation, and use of electronic cigarettes and heated tobacco products.

According to the Ministry of Health, on November 30, 2024, at the 8th Session of the 15th National Assembly, the National Assembly issued Resolution No. 173/2024/QH15, agreeing to ban the production, trading, import, storage, transportation, and use of electronic cigarettes, heated tobacco products, gases, and addictive substances that are harmful to human health from 2025.

In order to implement Resolution No. 173/2024/QH15 of the National Assembly, the Ministry of Health requests the Ministry of Information and Communications and the Ministry of Education and Training to continue to coordinate and direct the implementation of strengthening inspection, detection, and strict punishment of cases of advertising tobacco products, e-cigarettes, and heated tobacco products on the Internet.

Units shall strengthen propaganda and dissemination to civil servants, public employees and employees about regulations prohibiting the production, trading, import, harboring, transporting and using e-cigarettes and heated tobacco products in accordance with the spirit of Resolution No. 173/2024/QH15 of the National Assembly.

The Ministry of Health is drafting a Decree amending and supplementing a number of articles of Decree No. 117/2020/ND-CP dated September 28, 2020 of the Government regulating administrative sanctions for violations in the health sector.

In the draft, the Ministry of Health proposed a fine of 1 million to 2 million VND for the act of harboring or using e-cigarettes or heated tobacco products; a fine of twice the above fine for repeat offenses.

Violators will also have their electronic cigarettes and heated tobacco products confiscated for violations of the above regulations.

In addition, there are measures to force the destruction of electronic cigarettes and heated tobacco products; Send notices of administrative sanctions to the agencies and organizations where the violators work or study so that those agencies and organizations can handle them according to the regulations, rules and regulations of the agencies and organizations.
