Stopping a motorbike wearing a raincoat can result in a fine of up to 14 million VND

Current laws do not prohibit stopping to put on a raincoat, but if stopping in an unauthorized location causes a traffic accident, the driver can be fined up to 14 million VND.

The Ministry of Public Security said it received questions from some readers about how to stop and park vehicles safely. Are road users allowed to stop their vehicles on the road to put on raincoats?

Regarding this issue, the Ministry of Public Security said that current legal regulations do not prohibit and have provided specific instructions on stopping/parking vehicles, to ensure the most convenience and protect the safety of traffic participants.

The law does not prohibit stopping the vehicle to put on a raincoat. However, in cases where stopping/parking the vehicle to put on a raincoat does not comply with the law on traffic safety and order, causing danger to oneself and other road users, the driver will be punished.

Regarding stopping/parking, the 2024 Law on Traffic Safety and Order stipulates that drivers of vehicles participating in road traffic when stopping or parking on the road must comply with the following regulations: Signal to notify drivers of other vehicles participating in road traffic when entering or exiting a stopping or parking location; Do not affect pedestrians and vehicles participating in road traffic.

Regarding location, drivers of vehicles participating in road traffic are not allowed to stop or park in the following locations: on the left side of a one-way street; on a bridge, except in cases where traffic organization permits; under an overpass, except in places where stopping and parking are allowed; less than 20 m from a car parked in the opposite direction on a narrow street, less than 40 m on a road with one lane of motor vehicles in one direction;

On the road section for pedestrians to cross the road; at intersections and within 5 m from the edge of the intersection; at pick-up and drop-off points; at places where the road section is only wide enough for one lane of motor vehicles; within the safety range of railways; obscuring road signs, traffic lights,...

On the street, drivers of vehicles participating in road traffic may only stop or park their vehicles close to the curb or sidewalk on the right side of the road in the direction of travel; the nearest wheel must not be more than 0.25 m from the curb or sidewalk and must not cause obstruction or danger to people and vehicles participating in road traffic.

Penalties for parking violations with motorbikes

For violations, depending on the behavior and type of vehicle, administrative penalties may be imposed according to the provisions of Decree 168.

Specifically, for motorbikes, fines from VND 400,000 to VND 600,000 will be imposed for the following acts: stopping or parking on the roadway in a section of road outside urban areas where there is a sidewalk; stopping or parking on the roadway causing traffic obstruction; stopping or parking at pick-up and drop-off points, at road intersections, on the roadway reserved for pedestrians to cross the road; stopping or parking where there are signs prohibiting stopping/parking as prescribed.

Fine from 600,000 VND to 800,000 VND for stopping or parking on the bridge.

Fine from 800,000 VND to 1,000,000 VND for stopping or parking in a road tunnel in an incorrect place.

Fines from 10 million to 14 million VND for stopping or parking vehicles in violation of regulations causing traffic accidents.
