Building and perfecting the socialist rule of law state of Vietnam

Politburo member, President Nguyen Xuan Phuc, Head of the Steering Committee for the development of the "Strategy Project for Building and Perfecting the Socialist Rule of Law State of Vietnam to 2030, with a Vision to 2045" and Politburo member, Secretary of the Party Central Committee, Head of the Central Internal Affairs Commission Phan Dinh Trac, Deputy Head of the Standing Committee of the Steering Committee, recently had a working session with the Project Editorial Team on the first draft of the Project.

Thus, with the drastic and close direction of the Standing Committee of the Steering Committee, after 10 months of urgent and effective work, the first draft of the "Strategy Project on building and perfecting the Socialist Rule of Law State of Vietnam to 2030, with a vision to 2045" was formed.

Building and perfecting the Socialist Republic of Vietnam's rule of law state for the country's longevity

The 13th National Congress of the Party determined: "Continuing to build and perfect the Vietnamese socialist rule-of-law State of the people, by the people and for the people under the leadership of the Party is the central task of renewing the political system."

The general orientation is: "Improving the capacity, effectiveness and efficiency of State operations. More clearly defining the roles, positions, functions, tasks and powers of State agencies in exercising legislative, executive and judicial powers on the basis of the principles of the rule of law, ensuring that State power is unified, with clear division of labor, close coordination and enhanced control of State power. Building a complete, timely, synchronous, unified, feasible, public, transparent and stable legal system, focusing on the legitimate and just rights and interests of people and businesses to promote innovation, ensuring the requirements of rapid and sustainable development."

To implement the Resolution of the 13th National Party Congress, in May 2021, the Politburo decided to establish a Steering Committee to develop the "Strategy Project for Building and Perfecting the Socialist Rule of Law State of Vietnam to 2030, with a vision to 2045" consisting of 21 members, including 8 Politburo members and Party Central Committee Secretaries, with Comrade Nguyen Xuan Phuc, Politburo member, President as Head of the Steering Committee, Comrade Phan Dinh Trac, Politburo member, Party Central Committee Secretary as Deputy Head of the Steering Committee. The advisory and assisting agency of the Steering Committee is the Central Internal Affairs Committee.

With a high sense of responsibility and determination, in early June 2021, under the chairmanship of President Nguyen Xuan Phuc, the Standing Committee of the Steering Committee held a meeting to implement the Politburo's Decision.

At the meeting, President Nguyen Xuan Phuc emphasized: "This is an extremely important project, ensuring the Party's leadership in building and perfecting the socialist rule-of-law state, as well as ensuring the best service for the country's development under the Party's leadership, promoting democracy and the people's mastery..."

In July 2021, the Steering Committee held its first meeting, agreed to issue a Plan for developing the Project to assign tasks and determine the implementation roadmap, and established an Editorial Team to develop the Project to mobilize experts, scientists, and practical staff with extensive knowledge and experience in the rule of law state nationwide to participate in developing the Project.

Overcoming the difficulties caused by the COVID-19 pandemic, the Standing Committee of the Steering Committee successfully organized three national seminars, with the participation of Party and State leaders and members of the Steering Committee.

The first workshop, held in Hanoi on December 11, 2021, was on "Theoretical and practical issues on the Socialist Rule of Law State of Vietnam"; the second workshop, held in Da Nang on January 17, 2022, was on "Continuing to promote and improve the effectiveness of judicial reform to meet the requirements of building and perfecting the Socialist Rule of Law State of Vietnam by 2030, with a vision to 2045" and the third workshop, held in Ho Chi Minh City on March 17, 2022, was on "New and breakthrough issues in building and perfecting the Socialist Rule of Law State of Vietnam by 2030, with a vision to 2045".

The national seminars, as affirmed by the Head of the Central Internal Affairs Commission and Permanent Deputy Head of the Steering Committee Phan Dinh Trac, were held "in a spirit of frankness, responsibility, and boldness..., with breakthrough proposals based on theory and practice, in line with the characteristics and requirements of national development in the coming period," gathering many dedicated and profound opinions drawn from theoretical research and practical experience in legislation, executive and judicial branches.

This is a rich source of data and knowledge, valuable in both practice and theory for the Editorial Team to build the first draft of the project.

According to Associate Professor, Dr. Hoang The Lien, former Deputy Minister of Justice: "Experts, scientists and policy makers discussed the workshop topics deeply and frankly. The workshops also initiated and activated the thinking of society to contribute to the construction of the Project."

Professor, Doctor of Science Dao Tri Uc, Chairman of the Council of Professors of Law, State Council of Professors, assessed that the seminars "clarified the achievements and identified core, strategic, and breakthrough issues in continuing to build a socialist rule-of-law state in Vietnam."

Implementing the assignment of the Steering Committee, since July 2021, the Government Party Committee, the National Assembly Party Committee, the Supreme People's Court Party Committee, the Supreme People's Procuracy Party Committee, the Central Public Security Party Committee, the Central Military Commission, a number of other Party committees and organizations and theoretical research agencies at the Central level have urgently developed 27 thematic reports to serve the project development.

Agencies and organizations have conducted many discussions, seminars, and meetings to mobilize the participation of a large number of cadres, civil servants, public employees, experts, and scientists to contribute opinions in each specific field.

By the end of March 2022, the Project Editorial Team had collected more than 4,000 pages of documents from the results of three national conferences and 27 specialized branch newspapers.

The results of theoretical and practical research and the synthesis of the content of specialized reports and national seminars have helped the Steering Committee and the Editorial Board to draw very important conclusions, which are the basis for the development of the project.

As affirmed by President Nguyen Xuan Phuc in his concluding speech at the 3rd national conference in Ho Chi Minh City, the rule of law state is a method of organizing state power on the basis of respect for the constitution and law to ensure the democratic nature of the state. From there, the viewpoint was formed: "Building and perfecting the socialist rule of law state of Vietnam is the process by which our state establishes and operates the universal and progressive principles and characteristics of a modern rule of law state with a socialist orientation, ensuring the traditional cultural identity of Vietnam as a state of the people, by the people and for the people, led by the Party, with the goal of developing the country and bringing happiness to the people."

That process "must be based on the dialectical and historical thinking of Marxism-Leninism, creatively applying and developing President Ho Chi Minh's democratic and rule-of-law ideology; inheriting and promoting internal strength and achievements of the renovation cause over the past 35 years; selectively absorbing the world's experience; having a roadmap and steps suitable to the country's development requirements in each period."

Affirming that "building and perfecting the Vietnamese socialist rule-of-law state is an inevitable development law of the Vietnamese state, in line with the trend of the times, a consistent and correct policy of the Party, the aspiration and choice of the people, an urgent requirement for rapid and sustainable national development and deep and comprehensive international integration."

After more than 10 months of hard work and efforts, thoroughly grasping the consistent requirement set by President Nguyen Xuan Phuc that a project to build a Party resolution must be written in a way that is "easy for the people to understand, accepted by the Party, recognized by the world, easy to apply and easy to deploy," the Editorial Team to build the project together with the Central Internal Affairs Committee closely coordinated with the Office of the President, the Office of the Central Party Committee and experts and scientists to form the first draft of the "Project on Strategy for Building and Perfecting the Socialist Rule of Law State of Vietnam to 2030, with a vision to 2045" to submit to the Steering Committee as planned; the content of the draft Project closely follows the Platform for National Construction, the 2013 Constitution, the Resolutions of the Central Committee, especially the Resolution of the 13th National Party Congress, proposing many new and breakthrough points to create a strong change in building and perfecting the Socialist Rule of Law State of Vietnam in the coming time.
