On the morning of December 18, the National Assembly Standing Committee considered the proposal to add a number of draft laws to the 2024 law and ordinance making program.

Include 4 draft laws in the 2024 Law and Ordinance Building Program

Authorized by the Prime Minister, Minister of Justice Le Thanh Long reported on the summary and summary of the proposal to add 4 draft laws to the 2024 Law and Ordinance Development Program. Specifically: Law on Prevention and Combat of Human Trafficking (amended), Law on Chemicals (amended), Law on Value Added Tax (amended), Law on Management of Weapons, Explosives and Support Tools (amended).

Accordingly, regarding the draft Law on Prevention and Combat of Human Trafficking (amended), Minister Le Thanh Long said that the Law on Prevention and Combat of Human Trafficking was passed by the National Assembly in 2011 and will take effect in 2021. In addition to the results achieved, the implementation of the law has revealed a number of difficulties and shortcomings that require amendments to the current law. Accordingly, the dossier proposing the law development proposes that the National Assembly Standing Committee consider and add the draft law to the 2024 Law and Ordinance Development Program, submit it to the National Assembly for consideration and comments at the 7th Session and approve it at the 8th Session, with 3 policy groups: Completing regulations on the basis for identifying victims; Regulating the support regime for people in the process of being identified as victims; Completing regulations to improve the regime and policies to support and protect victims.

Regarding the draft Law on Chemicals (amended), Minister Le Thanh Long said that the Law on Chemicals was passed by the National Assembly in 2007 and took effect in 2008, promptly institutionalizing the Party's guidelines and policies and the State's policies. In addition to the achieved results, after 15 years of implementing the law regulating chemical activities, some shortcomings and difficulties have arisen in the implementation process. In order to continue to fully institutionalize the Party's guidelines and policies and the State's laws and policies on the development of the chemical industry and improve the effectiveness of state management of the development of the chemical industry, the dossier proposing the law has been studied and completed. The Government requests the National Assembly Standing Committee to consider and add the draft law to the 2024 Law and Ordinance Development Program, submit it to the National Assembly for consideration and comments at the 7th Session and approve it at the 8th Session.

Accordingly, the project is built with 4 policy groups: Sustainable development of the chemical industry into a modern foundation industry; Synchronous chemical management throughout the entire life cycle; Management of hazardous chemicals in products: Improving the effectiveness of ensuring chemical safety on the basis of.

Regarding the draft Law on Value Added Tax (amended), Minister Le Thanh Long stated that the Law on Value Added Tax was passed by the National Assembly in 2008 and took effect in 2009. To continue institutionalizing the policies and guidelines of the Party and State, the dossier proposes to develop a law with 5 policy groups: Completing regulations on subjects not subject to value added tax; Completing regulations on how to calculate value added tax; Completing regulations on value added tax rates; Completing regulations on input value added tax deduction; Completing regulations on value added tax refund.

Regarding the draft Law on Management of Weapons, Explosives and Supporting Tools (amended), the Law Drafting Proposal has been considered and approved by the Government in Resolution No. 165, with 4 policies: Completing regulations on the concept of weapons, supporting tools, components of weapons, supporting tools and new industrial explosives, regulations on management of production, business, import and export of knives with high lethality; Reducing and simplifying documents and records prescribed in administrative procedures on weapons, explosives, explosive precursors, supporting tools, regulations on granting licenses to use weapons and supporting tools, not specifying the time limit in the license to use and changing the issuance of registration certificates to granting licenses to use; Allowing foreign organizations and enterprises to donate, present, and aid weapons and supporting tools to Vietnam to serve the research, production of equipment, and use; Amending and supplementing a number of regulations on research, production and business use of industrial explosives, aiming to remove difficulties and obstacles for organizations and enterprises to serve socio-economic development.

At the meeting, Chairman of the Law Committee Hoang Thanh Tung, on behalf of the agency, reviewed the proposal to add 4 Law projects to the 2024 Law and Ordinance Development Program.

Accordingly, the Law Committee and agencies of the National Assembly agree with the necessity of amending the above 4 Laws to promptly institutionalize the Party's policies, overcome the limitations and shortcomings pointed out through the summary of the implementation of the laws, and meet practical requirements.

The draft Law on Value Added Tax (amended) and the draft Law on Prevention and Combat of Human Trafficking (amended) are proposed to be added to the 2024 Program by the National Assembly Standing Committee, submitted to the National Assembly for comments at the 7th session, and approved at the 8th session as proposed by the Government.

Regarding the draft Law on Chemicals (amended): Propose that the National Assembly Standing Committee decide to add it to the 2024 Program, submit it to the National Assembly for comments at the 8th session (postponed by one session compared to the Government's proposal) to have more time to research, perfect policies, assess impacts, and ensure the quality of the draft Law.

Regarding the draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended): the majority of opinions suggested that the National Assembly Standing Committee decide to add it to the 2024 Program, submit it to the National Assembly for comments and approval at the 7th session according to the procedure at one session to soon promulgate the Law, meeting practical requirements.

Impact assessment, compliance with legal document promulgation procedures

Regarding these 4 draft laws, Chairman of the National Defense and Security Committee Le Tan Toi said that the National Defense and Security Committee has reported to the Law Committee for coordination in review. At the same time, he expressed high agreement and many comments on these 4 draft laws, and high agreement with the review report of the Law Committee.

Chairman of the National Defense and Security Committee Le Tan Toi highly appreciated the Government's documents and preparations for these four draft laws.

Regarding some opinions on the draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended), after 5 years of implementation, Chairman of the National Defense and Security Committee Le Tan Toi said that in reality, out of 40,000 crimes related to weapons and explosives, over 58% of the cases involved the use of knives and rudimentary weapons, very serious crimes such as murder, kidnapping, drugs, intentional injury, resisting law enforcement officers, etc. Among these cases, many police officers were injured and sacrificed while on duty, etc. Therefore, the reality is that it is very necessary to amend this draft Law.

Therefore, based on the opinion of the Ministry of Public Security, the Government has proposed to add this Law project to the 2024 Law and Ordinance Development Program and pass it at the 7th Session as per the Government's Submission.
Based on practical requirements, every day and every year there will be more cases using many types of weapons, materials, and supporting tools such as knives, causing deaths to people. Therefore, Chairman of the National Defense and Security Committee Le Tan Toi proposed to pass this Law project in a shortened session.

Commenting on the Law on Prevention and Combating Human Trafficking, Chairwoman of the Judicial Committee Le Thi Nga expressed her agreement with the need to amend the 2011 Law on Prevention and Combating Human Trafficking. After more than 10 years of implementation, the Law has created a favorable legal basis for authorities in the fight against human trafficking, supporting victims of trafficking and has achieved many positive results. However, the process of law enforcement has also revealed a number of shortcomings, difficulties and inadequacies that need to be amended and supplemented.

In addition, the Party's viewpoint on crime prevention and control in the new situation also needs to be institutionalized. The Constitution and related laws have been amended, so this Law also needs to be amended to ensure the consistency of the legal system, in accordance with international treaties to which Vietnam is a member.

The dossier for the proposal to draft the law was carefully and meticulously prepared by the presiding agency, basically meeting the requirements prescribed by the Law on Promulgation of Legal Documents. However, the Judicial Committee requested that the presiding agency should continue to supplement the opinions of the Central Committee of the Vietnam Women's Union, the agency assigned to the task of propaganda in the work of preventing and combating trafficking in women and children, and a number of other relevant ministries, branches and localities.

National Assembly Chairman Vuong Dinh Hue said that the submission of contents is in accordance with the Law on Promulgation of Legal Documents. However, the National Assembly Chairman noted that ministries and branches, including the Ministry of Justice, should advise the Government to limit the number of projects submitted to the National Assembly Standing Committee for consideration and decision to add to the Program. Although the Law allows the National Assembly Standing Committee to consider adjusting the Program, it should only be added when necessary, while the annual Law and Ordinance Development Program is decided by the National Assembly. Although the Law allows it, it should be limited, only submitting to the National Assembly Standing Committee for decision to add to the Program those that are truly urgent and unexpected. Therefore, agencies should speed up the preparation of projects to submit to the National Assembly for comments.

The submission of draft laws must be calculated comprehensively, such as tax laws, not just VAT. When the National Assembly passed the Resolution on the global minimum tax, it required a comprehensive review of the investment incentive law, tax laws, etc., so it is necessary to proactively calculate the overall tax, including laws on various taxes and the Tax Administration Law. The National Assembly Chairman requested that agencies speed up the progress, avoiding the situation of doing whatever is required, leading to a lack of consistency and unity.

In resolutions on the Law and Ordinance Development Program, it is necessary to clearly stipulate that in the process of researching and perfecting the law development, in cases where new policies arise or there are amendments or supplements to the stated policies, it is necessary to carefully assess the impact and strictly comply with the process of promulgating legal documents.

Minister of Justice Le Thanh Long spoke to accept and explain the opinions raised at the discussion session. Regarding the Government's Submissions for the 4 draft laws, Minister of Justice Le Thanh Long said that the Chemical Law project is expected to be postponed one session, that is, from the 7th Session to the 8th Session, it will be transferred from the 8th Session to the 9th Session.

Regarding the draft Law on Management and Use of Weapons, Explosives and Support Tools (amended), Minister of Justice Le Thanh Long stated that when the Ministry of Public Security submitted it and the Government discussed it, it is currently open for submission at the 7th Session. The Ministry of Public Security will continue to study, review and approve it at a session. Other draft laws will basically remain unchanged.

Regarding the issue of submitting and supplementing the 2024 Law and Ordinance Development Program, Minister of Justice Le Thanh Long emphasized that the Ministry will consider and research more carefully and thoroughly to submit to the National Assembly Standing Committee, continue to receive and consult with ministries and branches, and shorten the scope of the submitted projects.

At the meeting, with 100% of votes in favor, the National Assembly Standing Committee approved the proposal to add a number of draft laws to the 2024 Law and Ordinance Development Program (including the following drafts: Law on Prevention and Combat of Human Trafficking (amended); Law on Value Added Tax (amended); Law on Chemicals (amended); Law on Management and Use of Weapons, Explosives and Support Tools (amended).
