Outstanding policies taking effect in September 2024

In September 2024, many new policies will take effect, such as: new regulations of the Government on the number of deputy heads of agencies and units; Credit policy for clean water supply and rural environmental sanitation.

New Government regulations on the number of deputies of agencies and units

The Government issued Decree No. 83/2024/ND-CP amending regulations on the number of deputies of agencies and units. Decree No. 83/2024/ND-CP takes effect from September 1, 2024.

Decree No. 83/2024/ND-CP dated July 10, 2024 amending and supplementing a number of articles of Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies, which have been amended and supplemented by a number of articles under Decree No. 101/2020/ND-CP dated August 28, 2020 of the Government; Decree No. 10/2016/ND-CP dated February 1, 2016 of the Government regulating government agencies has been amended and supplemented by a number of articles under Decree No. 47/2019/ND-CP dated June 5, 2019 of the Government and Decree No. 120/2020/ND-CP dated October 7, 2020 of the Government regulating the establishment, reorganization and dissolution of public service units.

According to Decree No. 10/2016/ND-CP regulating government agencies, which has been amended and supplemented in Decree No. 47/2019/ND-CP, the organizational structure of government agencies includes: Board; Office; Affiliated career organizations (if any).

Regarding the number of deputies of the above organizations and units, according to the new regulations in Decree No. 83/2024/ND-CP, the Board and Office with 15 to 20 civil servants and public employees are arranged to have no more than 2 deputies; the Board and Office with more than 20 civil servants and public employees, the Head of the Government agency decides the number of deputies of each unit, ensuring an average of no more than 3 people per unit.

Credit policy for clean water supply and rural environmental sanitation

On July 15, 2024, the Prime Minister issued Decision No. 10/2024/QD-TTg on credit for clean water supply and rural environmental sanitation.

This Decision stipulates the credit policy for clean water supply and rural environmental sanitation to implement the National Strategy on clean water supply and rural sanitation to 2030, with a vision to 2045 according to Decision No. 1978/QD-TTg dated November 24, 2021 of the Prime Minister to provide loans for investment in new construction, upgrading, renovation and repair of 2 types of works, including: Household-scale water supply works; household environmental sanitation works.

The loan recipients are households residing in rural areas where they have registered permanent or temporary residence. The loan conditions are that these households must reside in rural areas where there are no water supply or household sanitation facilities or where there are damaged facilities that need to be rebuilt, upgraded, renovated, or repaired.

The maximum loan amount is 25 million VND/project type/customer within a maximum loan term of 5 years (i.e. 60 months) with the following interest rates: Loan interest rate: 9%/year; overdue interest rate: 130% of the loan interest rate. Decision No. 10/2024/QD-TTg takes effect from September 2, 2024.

New regulations on converting state-owned enterprises into single-member LLCs

The Government issued Decree No. 89/2024/ND-CP on converting state-owned enterprises established and operating under the Law on State-owned Enterprises into single-member limited liability companies organized and operating under the provisions of the Law on Enterprises.

According to the Decree, the subjects of application are: Enterprises established and operating under the provisions of the Law on State-owned Enterprises that have not been converted into single-member LLCs, including: Enterprises decided to be established by ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally-run cities or assigned to manage (referred to as state-owned companies); Enterprises decided to be established by single-member LLCs in which the State holds 100% of the charter capital or assigned to manage (referred to as unconverted subsidiaries).
