Tu Ky district proposed to allow the illegal construction on the agricultural land of Mr. Nguyen Van Chien's family to exist for the public interest.
Tu Ky District People's Committee has proposed that the Provincial People's Committee approve the existence of an eco-tourism amusement park and agree with the application of Mr. Nguyen Van Chien's family (known as "Chien Lon" by local people) in O Me village, Hung Dao commune (Tu Ky) to donate the right to use more than 1 hectare of agricultural land and assets attached to the land to the community of O Me village, Hung Dao commune to use as an eco-tourism amusement park.
According to the People's Committee of Tu Ky district, in 2016, Mr. Nguyen Van Chien's family received the transfer of agricultural land from a number of households in the village with a total area of 10,735 m2In 2018, Mr. Chien's family bid for 720 m2Aquaculture surface land of Hung Dao Commune People's Committee. From 2018 to 2019, Mr. Chien arbitrarily leveled and changed the land use purpose on the entire agricultural land area, encroaching on nearly 700 m2Land for transportation and irrigation to build a successful amusement park for free public visits. Particularly 720 m2The water surface land for Mr. Chien's family's aquaculture contracted by the Commune People's Committee remains unchanged.
According to the provisions of Point e, Clause 1, Article 179; Point c, Clause 2, Article 174 of the 2013 Land Law, households and individuals using agricultural land allocated by the State within the limit; land allocated by the State with land use fees collected, land leased with one-time land rent payment for the entire lease term, land recognized by the State for land use rights; land received through conversion, transfer, donation, inheritance have the right to donate land use rights to the community to build works serving the common interests of the community.
