To bring the Land Law - a very important law into life, Hai Duong has promptly issued complete guiding documents and detailed regulations for law implementation.
As of October 27, out of 63 provinces and cities nationwide, only Hai Duong and An Giang have issued complete guidance documents and detailed regulations for the implementation of the 2024 Land Law.
Since the revised Land Law was passed, people across the country have hoped for a clearer legal mechanism in land use and transfer.
Across the country, recently, many places have encountered a situation where applications for land use right certificates, transfers, land subdivisions, or property mortgages have been delayed or refused to be processed due to insufficient legal basis.
Many families have fulfilled their financial obligations, but have not yet received their "red books" because the authorities have not been able to process their applications. Some people have had to postpone real estate transactions and bank loans because they do not have official documents.
The delay in issuing documents guiding the implementation of the law in many localities has caused even greater consequences, as many real estate projects have stalled, affecting urban development and the entire economy.
Remember, since March 2024 (5 months before the Land Law took effect), the Prime Minister has issued urgent instructions, requiring ministries, branches and localities to urgently complete decrees, circulars and guiding decisions to soon implement the law.
At that time, the Government was determined to submit to the National Assembly for approval allowing real estate laws to take effect 5 months earlier than previously planned (from August 1, 2024 instead of January 1, 2025).
It should also be mentioned that before pressing the button to approve the early implementation of the above laws, National Assembly delegates also expressed concerns about their implementation because at that time, the guiding documents were still lacking.
However, with the determination of the Government, Government members and localities, the National Assembly has agreed to let the laws come into effect soon. Everyone expects the laws to unlock resources and create new momentum for socio-economic development.
It should be added that localities are slow to issue regulations due to great pressure in terms of time and the difficulty of the issues. Typically, there are problems in calculating land use fees for residential land transferred by project investors; handling land used by state-owned enterprises after the equitization process; problems with the authority to issue certificates in cases of land use purpose change, etc.
A series of difficulties have been overcome by Hai Duong's departments and branches, bringing about concrete results, contributing to the completion of a clear and detailed legal corridor to further improve the efficiency of land resource management and use. The fact that Hai Duong is the locality that promptly issued all relevant guiding documents to effectively implement and bring the 2024 Land Law into life demonstrates the high determination of the provincial leaders as well as specialized agencies.
The 2024 Land Law has many new, innovative and groundbreaking contents. When detailed guidance documents are issued, the 2024 Land Law will immediately take effect, especially the contents related to the immediate interests of land users such as compensation, support and resettlement policies when the State reclaims land; land finance policies, land prices, etc.
Along with the Housing Law and the Real Estate Business Law passed by the National Assembly at the end of last year, the 2024 Land Law has created a synchronous completion of the legal system related to land activities and real estate business.
Now that the law is in place and the guiding documents for its implementation are also available, Hai Duong residents and businesses can rest assured about the expectations of removing obstacles when the law has been and is being put into practice.
