After the Politburo issued conclusions stating the policy of abolishing the district level, the question that many people are interested in is how the staff, civil servants and public employees here will be arranged.
Please reply, as of the morning of March 5, the Central Government has not yet had any specific policies, guidelines, or regulations on this issue. However, there are some indications, experiences, and approaches that are suggestions for everyone to consider.
The first sign, on March 1, in Official Dispatch No. 006/BNV-CQDP, the Ministry of Home Affairs requested the People's Committees of provinces and cities to review and report on the number of commune-level officials and civil servants, and send it to the Ministry before March 10 to report to competent authorities.
Recently, when the district-level police were abolished, part of the force was transferred to the commune-level police, part was transferred to the provincial-level police, some people were given early retirement benefits... In Hai Duong, 1,133 leaders, commanders, officers and soldiers of the district-level police were transferred to work at the departments of the provincial police, commune-level police and some related positions, of which 201 comrades held the positions of department heads and deputy department heads of the provincial police and heads and deputy heads of commune-level police.
A number of district-level cadres, civil servants and public employees will be transferred to the commune level, which is a possibility. The Politburo has also requested to continue merging some commune-level administrative units to form larger communes, creating new development space. When communes are larger, the requirements for leadership, management and implementation of cadres, civil servants and non-professional workers will also be higher. Therefore, district-level cadres, civil servants and public employees transferred to the commune level will help improve the quality and qualifications of the grassroots team. Current commune-level cadres, civil servants and non-professional workers with limited qualifications and capacity may have to quit their jobs, retire early or be transferred to work in villages and residential areas...
Another group of district-level cadres, civil servants and public employees can be transferred to work at the provincial level if they meet the requirements on organizational structure, capacity, moral qualities, political standards, etc.
In fact, many elderly cadres, civil servants and public employees who are about to retire at many levels and in many sectors have voluntarily retired early and received a large amount of money according to Decree 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in the implementation of the organization and apparatus of the political system. Another group has asked to retire and received policies according to Decree 177/2024/ND-CP dated December 31, 2024, which stipulates policies and regimes for cases of non-re-election, reappointment and cadres who quit their jobs and retire at will.
When the district level is abolished, many people will certainly continue to quit their jobs to enjoy the above benefits.
The Ministry of Home Affairs also informed that it had reported to the Government Party Committee to report to the Politburo for the policy of expanding the scope and subjects of application of Decree 178.
According to Conclusion No. 127-KL/TW of the Politburo, the Government Party Committee must report to the Politburo for the policy on studying the orientation of merging some provincial-level units, not organizing at the district level, merging some commune-level units, and implementing the 2-level local model no later than March 9, 2025. After the Politburo's policy on not organizing at the district level, state agencies must institutionalize it with specific policies, laws, and regulations. At that time, it will be clear where the cadres, civil servants, and public employees are going.

How to deal with redundant staff when district level is abolished?
According to current regulations, in case of dissolution of district-level administrative units due to administrative unit rearrangement, redundant cadres will be resolved with regimes and policies according to Article 12 of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee, as follows:
Retain the regimes and policies on salary and allowances for leadership positions for those who continue to work but do not hold previous positions until the end of the election term (for those holding elected positions) or the end of the appointment term for leadership and management positions (for those holding appointed positions). In case the remaining term of the election term or appointment term is less than 6 months, the full 6 months will be reserved. After the end of the reserved period, salary and position allowances (if any) will be implemented according to the current position and title or retirement regime will be resolved according to regulations.
Cadres, civil servants, public employees, and redundant workers of agencies and organizations due to the arrangement of district-level administrative units, depending on each case, are recruited, received, mobilized, and rotated to work at agencies, organizations, and units in the political system according to task requirements or enjoy regimes and policies for retirees, those who quit their jobs, or those who are downsized according to Government regulations.
In addition to the above-mentioned policies and regimes, based on the local budget balance, the provincial People's Committee shall submit to the People's Council of the same level to issue support policies for redundant cadres, civil servants, public employees, and workers of agencies and organizations due to the arrangement of district-level administrative units in the area.
In the coming time, when there is more specific information about abolishing the district level, policies and regimes will likely have to change to suit reality.
