Focus on directing and implementing the Land Law

Prime Minister Pham Minh Chinh requested localities to focus on directing the full promulgation of assigned contents and detailed regulations in the Land Law.

The Prime Minister requested strict implementation of telegrams and instructions on the issuance of documents detailing and guiding the implementation of the Land Law.

On October 10, Prime Minister Pham Minh Chinh issued Official Dispatch No. 105/CD-TTg to the Ministry of Natural Resources and Environment and Chairmen of People's Councils and Chairmen of People's Committees of provinces and centrally-run cities on focusing on directing and implementing the Land Law.

The telegram stated that the Land Law was passed by the National Assembly and took effect from August 1, 2024, and has initially come into effect, contributing to continuing to innovate and improve institutions and policies, and improving the effectiveness and efficiency of land management and use.

The implementation of the Land Law to come into effect soon is an urgent requirement and urgent task to resolve practical difficulties and problems.

At the proposal of the Provincial Party Committees, City Party Committees, and People's Committees of provinces and centrally-run cities, the Government has submitted to the National Assembly a proposal to adjust the effective date of the Land Law 5 months earlier.

The Prime Minister has strongly directed the organization of law enforcement, especially the issuance of detailed regulations (Document No. 202/TTg-NN dated March 26, 2024, Official Dispatch No. 53/CD-TTg dated May 26, 2024, Official Dispatch No. 79/CD-TTg dated August 13, 2024...).

Recently, the Government and ministries and branches have completed the issuance of documents under the authority of the Government, the Prime Minister and the ministries before August 1, 2024.

The Prime Minister commended ministries, branches and localities for their great efforts in issuing detailed regulations and guiding the implementation of the law, creating unity, synchronization and legal basis for the smooth implementation of the Land Law, promoting the effectiveness of new and progressive policies set forth by the Land Law.

However, through grasping the actual situation and synthesizing reports from agencies, departments, and localities, provinces and cities have not yet fully promulgated the contents assigned in the law and decrees.

In particular, some provinces and cities have not yet issued any detailed regulations or instructions for implementing the Land Law, including Cao Bang, Ninh Binh, Quang Nam, Quang Ngai, Gia Lai, Dak Nong, Tien Giang, Can Tho, Bac Lieu, Ca Mau, Phu Yen, Binh Phuoc, and An Giang.

The Prime Minister criticized provinces and cities for being slow in issuing detailed regulations and instructions for implementing the Land Law.

The Prime Minister requested the Chairmen of People's Councils and Chairmen of People's Committees of provinces and centrally-run cities to strictly implement the telegrams and instructions of the Prime Minister.

Localities that are slow to issue regulatory documents under their authority must assess the causes and impacts affecting the results of implementing socio-economic development, security and defense tasks in their localities; organize reviews and clarify the responsibilities of organizations and individuals that caused the delay in issuance, and report to the Prime Minister the results of handling before October 15, 2024.

Focus on directing the full promulgation of assigned contents detailed in the Land Law and decrees detailing the implementation of the Land Law, to be completed before October 15, 2024, and report the results to the Ministry of Natural Resources and Environment for synthesis and reporting to the Prime Minister. Be responsible to the Government and the Prime Minister if there is any delay in promulgating the above documents.

Prepare conditions for effective implementation of the Land Law at the local level, including perfecting the organizational structure of land fund development organizations and land registration offices; allocating human resources, funding, building databases, issuing economic and technical norms, product unit prices, etc.

Continue to promote training, propaganda, and dissemination widely, regularly, and continuously to all levels, sectors, people, and businesses to create consensus and unity in awareness and implementation.

Proactively coordinate with relevant ministries and branches to resolve problems arising in practice in localities; promptly report to the Government and the Prime Minister on issues beyond their authority, and avoid bottlenecks that affect socio-economic development and the legitimate rights and interests of people and businesses.

Strictly implement coordination between agencies and units in handling administrative procedures to ensure tightness, timeliness and efficiency, especially in groups of administrative procedures and interconnected public services.

Strengthen inspection, examination and handling of violations by state management agencies and land users. In the immediate future, step up inspection of the implementation of the Land Law at the local level.

The Prime Minister assigned the Ministry of Natural Resources and Environment to regularly monitor and urge localities to organize the implementation of the Land Law and detailed regulations and instructions for law implementation.

The Prime Minister assigned Deputy Prime Minister Tran Hong Ha to direct ministries, branches and localities to strictly and effectively implement this dispatch.

The Government Office monitors and urges relevant ministries, agencies and localities to implement this Circular, promptly reporting to the Prime Minister and Deputy Prime Minister in charge on any problems and difficulties in the implementation process.
