National Assembly delegates of Hai Duong province contribute ideas to 4 draft laws

These are four important bills discussed by National Assembly deputies in groups for 1.5 days.

The National Assembly Delegation of Hai Duong province discussed in group 14 with the National Assembly Delegations of Son La and Binh Thuan provinces.

On June 9 and the morning of May 10, National Assembly deputies of Hai Duong province participated in group discussions on 4 draft laws: Citizen Identification (amended), Telecommunications (amended), Land (amended), and Management and protection of national defense works and military zones.

Concerns about the basis for calculating land prices based on market principles

Commenting on the draft Land Law (amended), delegate Nguyen Ngoc Son (National Assembly Delegation of Hai Duong province) proposed to continue clarifying the bases and specific regulations on land valuation methods according to market principles.


Comrade Le Van Hieu, Standing Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council, Head of the National Assembly Delegation of Hai Duong province chaired the group discussion session.

Delegate Nguyen Ngoc Son said that the Economic Committee's review report clearly mentioned the calculation of land prices in a way that harmonizes the interests of the state, investors and people. If the market price is too high, it will also affect the efficiency of investors and will not attract investment. Delegate Nguyen Ngoc Son said that it is necessary to attract investment so that land can be used for production, business and contribute to socio-economic development, not just because it is effective to collect money from land tax.

Regarding the regulation on extending the time limit for granting land use right certificates to households and individuals, delegate Nguyen Ngoc Son said that after many amendments, this is the third time to continue extending the time limit for individuals using land with houses and constructions that are in accordance with the planning, without disputes, and only need confirmation from the People's Committee at the commune level. Through the process of receiving people in Hai Duong province, delegate Nguyen Ngoc Son realized that this is a prominent issue.


Delegate Nguyen Ngoc Son (National Assembly Delegation of Hai Duong province) proposed to continue clarifying the bases for calculating land prices.

"If there are no specific regulations, it will lead to the problem of legalizing past violations. Although the encroached land is also in the planning of the district and province, the origin is encroachment and then legalized only with a certificate from the People's Committee at the commune level. I suggest that the drafting committee consider carefully because the number of these cases is currently very large," said delegate Nguyen Ngoc Son.

Also contributing to the draft Land Law (amended), delegate Nguyen Thi Mai Thoa (National Assembly Delegation of Hai Duong Province) assessed that the draft law submitted this time has specific regulations on land recovery for construction of public and non-public facilities. The draft also clearly stipulates cases where it is absolutely necessary to recover land for socio-economic development for national and public interests, including land for construction of cultural facilities, historical relics, scenic spots, education and training, and sports.


Delegate Nguyen Thi Mai Thoa (National Assembly Delegation of Hai Duong province) highly appreciated the equality in land acquisition for construction.

The draft Law on Citizen Identification (amended) still has many unclear points.

At the group discussion session, delegate Nguyen Thi Viet Nga (Deputy Head of the National Assembly Delegation of Hai Duong province) said that there were many items that delegates found unclear, such as explanations, use of words, concepts, etc.

Regarding regulations related to specialized databases, delegate Nguyen Thi Viet Nga wondered how many provinces, centrally-run cities and political organizations are digitized for storage. The draft does not clearly stipulate whether all current specialized databases are digitized or not, and whether specialized databases that have not been digitized are considered specialized databases or not?

Delegate Nguyen Thi Viet Nga agreed with the draft on the content and information on the citizen identification card. The delegate said that the place of birth registration is important information to distinguish one individual from another and is not information that can be changed.


Delegate Nguyen Thi Viet Nga (National Assembly Delegation of Hai Duong Province) said that many items in the Draft Law on Citizen Identification (amended) are still unclear, such as explanations, use of words, concepts...

"In our entire life, we only have one time, one place to register our birth, so showing our citizen identification is reasonable. In particular, there are cases where the names are the same, even the date, month, and year of birth, so this place of birth registration is an important piece of information to distinguish", delegate Nguyen Thi Viet Nga analyzed.

Redesigning the Law on Management and Protection of National Defense Works and Military Zones

According to delegate Bui Sy Hoan (Director of the Department of Justice, National Assembly Delegation of Hai Duong province), the construction of the Law on Management and Protection of National Defense Works and Military Zones by listing the contents and then specifying each content one by one makes the law long and confusing. Delegate Bui Sy Hoan suggested keeping the contents and redesigning them to be more scientific.


According to delegate Bui Sy Hoan (National Assembly Delegation of Hai Duong province), the development of the Law on Management and Protection of National Defense Works and Military Zones is not scientific.

Regarding the provisions on applied works, the draft law has not clarified how defense works or military areas are classified, and how applied works are classified and managed. Clause 5, Article 3 stipulates that applied works used for civil purposes shall be managed and used in accordance with the provisions of the law on management and use of public assets, and in the case of use for military and defense purposes, they shall be managed and protected in accordance with the provisions of this law.

If managed as a civil project, its function can be changed or even demolished. Thus, when it is needed for defense purposes, it is no longer valuable. Delegate Bui Sy Hoan said that there should be clearer regulations on the management of applied projects for more effective use.

Delegate Bui Sy Hoan also contributed many opinions on the shortcomings in the Telecommunications Law Project (amended) at the group discussion session on the morning of June 9.
