The Politburo basically agreed to the policy of adjusting the scope and subjects of application of Decree No. 178/2024/ND-CP, dated December 31, 2024 of the Government to handle some shortcomings in policies and regimes.
The Politburo issued Conclusion Notice No. 75-TB/TW dated March 7, 2025 on adjusting the scope and subjects of application of policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system.
Accordingly, at the meeting on February 20, 2025, after listening to the Government Party Committee's report on adjusting the scope and subjects of application of Decree No. 178/2024/ND-CP, dated December 31, 2024 on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system, the opinions of agencies, the Politburo basically agreed to the policy of adjusting the scope and subjects of application of Decree No. 178/2024/ND-CP, dated December 31, 2024 of the Government to handle some shortcomings in policies and regimes.
The Politburo agreed to make adjustments to the following groups of subjects:
(1) Cadres who are not old enough to be re-elected or re-appointed and cadres who are old enough to be re-elected or re-appointed to the same-level Party Committee with a working period of 30 to 60 months from the date of the congress are of retirement age and cadres who are participating in Party Committees in Party Committees must end their activities and consolidate the organizational apparatus, and have a working period of 60 months or less are of retirement age, and who wish to retire early to create conditions for personnel arrangement and are approved by competent authorities (stipulated in Clauses 1, 2, 3, 4, Article 2, Decree No. 177/2024/ND-CP).,December 31, 2024 of the Government).
(2) Cadres, civil servants, public employees, and workers receiving salaries from the state budget according to the provisions of the labor law before January 15, 2019 who have 5 years left until retirement age in public agencies and units of the Party, the State, and socio-political organizations from the central to district levels and the armed forces are not directly affected by the reorganization of the apparatus but must streamline the payroll, streamline the apparatus, restructure and improve the quality of the contingent of cadres, civil servants, and public employees of the political system.
(3) People working within the payroll quota and receiving salaries from the state budget at associations assigned tasks by the Party and State at the central and local levels due to the direct impact of the implementation of organizational arrangement, consolidation and merger.
The Politburo assigned the Government Party Committee to absorb the Politburo's opinions and direct the Ministry of Home Affairs to carefully review the provisions of the decree to make reasonable adjustments to thoroughly resolve problems arising in practice and feasibility during implementation, ensuring consistent implementation of policies, in line with objectives, creating favorable conditions for the implementation of organizational arrangements of the political system; retaining qualified, capable and talented people, streamlining the payroll, restructuring and improving the quality of cadres, civil servants and public employees to meet the requirements of national development tasks.
Based on the policy of the Politburo, the Government Party Committee urgently directed the institutionalization for implementation. Agencies, units and localities strengthened political and ideological education, propaganda, and public opinion orientation to create consensus and unity in organization and implementation.
Clauses 1, 2, 3, 4, Article 2, Decree No. 177/2024/ND-CP,December 31, 2024 of the Government specifically as follows:
1. Cadres specified in Clause 1 and Clause 3, Article 4 of the Law on Cadres and Civil Servants 2008 (amended and supplemented by the Law on Amending and Supplementing a Number of Articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019) holding full-time positions and titles elected for a term in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, socio-political organizations at the Central level, at the provincial, district and commune levels but not meeting the age requirements for re-election or reappointment to the Party Committee at the same level.
The cadres specified in this clause also apply to cases where cadres are eligible for re-election to the Party Committee but are not old enough to be re-elected to leadership positions of the government, the Vietnam Fatherland Front, and socio-political organizations at the time of election or congresses at the same level to elect those positions.
2. Officers, professional soldiers, defense officials, and people working in secretarial work who receive salaries like soldiers in agencies and units of the People's Army and the People's Public Security, holding positions and titles in the structure of participating in the Party Committee, full-time members of the Inspection Committee at the same level but do not meet the age requirement for re-election to the Party Committee at the same level.
In this case, the retirement age is calculated according to the provisions of the Law on Officers of the Vietnam People's Army, the Law on Professional Soldiers, Workers and National Defense Officials, the Law on People's Public Security, the Law on Cryptography and implementing guidelines.
3. Civil servants holding a fixed-term appointment position whose current position is part of the structure of participating in the Party Committee at the same level but do not meet the age requirement for re-election to the Party Committee (including the positions and titles of Chairman, Vice Chairman of the People's Committee of the district, town, ward where urban government is implemented; Commander of the Military Command at the commune level).
4. The subjects specified in Clause 1, Clause 2, Clause 3 of this Article meet the age requirements for re-election and reappointment to the same-level Party Committee, have a working period from the date of the congress starting from 30 to 60 months, are eligible for retirement age, but due to the arrangement of Party Committee personnel, they wish to retire and are approved by the competent authority.
