The Prime Minister noted that the review and handling of problems in the system of legal documents in particular and the building and completion of institutions and laws in general must be timely and ensure quality.

The Prime Minister chaired a meeting of the Steering Committee to review and handle problems in the system of legal documents.

On the afternoon of September 28, at the Government Headquarters, Prime Minister Pham Minh Chinh, Head of the Steering Committee for reviewing and handling difficulties in the system of legal documents (Steering Committee) chaired the third meeting of the Steering Committee.

Also attending the meeting were Deputy Prime Ministers Le Thanh Long and Ho Duc Phoc; Ministers, leaders of ministries, branches and members of the Steering Committee.

Implementing the conclusion of Prime Minister Pham Minh Chinh at the Second Session of the Steering Committee, through reviewing the issue of decentralization and authorization in the Law on Organization of the Government 2015 and the Law on Organization of Local Government 2015, members of the Steering Committee found a number of problems related to the subjects being decentralized, receiving decentralized, the process of implementing decentralization; the authorized subjects and the authorization procedures.

The Steering Committee also reviewed and found specific problems in other laws. In particular, in the 2020 Law on Environmental Protection, there are problems with investment projects requiring the conversion of land use purposes for rice cultivation from 2 crops or more; regulations on approving the results of environmental impact report appraisal.

In the Law on Resources and Environment of Sea and Islands, there are problems related to the duration of the license for dumping at sea; procedures for dumping at sea. In the Law on Cultivation 2018, there are problems in the regulations on conditions for trading fertilizers.

The Steering Committee also studied the problems and inadequacies in the laws that were not within the scope of the requested review, and found that there were 10 laws with 26 contents that had conflicts, overlaps, inadequacies, and problems that needed to be considered and resolved.

Along with the heated discussion and comments on the content of the problems and shortcomings of the above 5 Laws, the members of the Steering Committee proposed to promote the handling of problems and shortcomings related to administrative procedures approved by the Prime Minister in Decision No. 1015/QD-TTg dated August 30, 2022, especially some problems and shortcomings in the draft laws that are included in the law and ordinance making program of the National Assembly, the National Assembly Standing Committee or are under development.

Concluding the meeting, Prime Minister Pham Minh Chinh highly appreciated and basically agreed with the dedicated, responsible, practical, profound and quality opinions of the Deputy Prime Ministers and members of the Steering Committee at the meeting; assigned the Government Office to preside over and coordinate with the Ministry of Justice and relevant ministries and branches to fully absorb the opinions and issue a Notice of the Meeting's Conclusion for unified implementation.

The Prime Minister requested that members of the Steering Committee closely follow the operating regulations, contents, plans and activities of the Steering Committee to participate in contributing efforts and intelligence to reviewing and handling problems in the system of legal documents.

Ministers and heads of sectors focus on directing resolutely and effectively, concentrating human resources, financial resources, and facilities on the work of building and perfecting legal institutions; including reviewing and handling obstacles in the system of legal documents to clear and mobilize resources for development, helping to accelerate and make a breakthrough in completing the socio-economic development targets in 2024 and the goals set by the 13th National Party Congress.

In particular, the construction and completion of legal institutions must focus on removing obstacles; further promoting decentralization and delegation of power; reducing administrative procedures, reducing inconvenience for people and businesses, eliminating the request-grant mechanism; with a breakthrough mindset, strategic and long-term vision for development.

The Central Government and ministries and branches only focus on building laws, institutions, mechanisms, policies, strategies, plans and programs; promoting decentralization, along with resource allocation, improving the implementation capacity of lower levels and designing inspection and supervision tools; localities decide, localities do, localities are responsible.

The Prime Minister noted that the review and handling of problems in the system of legal documents in particular and the building and perfecting of institutions and laws in general must be timely and of high quality; in the process of building laws, close coordination must be maintained with the agencies of the National Assembly.

The Prime Minister noted that, depending on the relationship of the law, some contents must be detailed and specific, some provisions must be general in nature, especially those issues with many fluctuations, then assigned to the authorities from the central to local levels to implement based on practice, in the spirit of "What is ripe, clear, proven to be correct in practice, effectively implemented, and agreed by the majority, then continue to implement and legalize; what has no regulations or in reality exceeds the regulations, then boldly pilot, while doing, learn from experience, gradually expand, not be perfectionist and not hasty".

The Head of Government requested that along with handling difficulties and inadequacies in 5 laws: Law on Cultivation 2018, Law on Environmental Protection, Law on Natural Resources, Environment of Sea and Islands, Law on Organization of Government, Law on Organization of Local Government, Ministries and branches urgently develop 01 law to amend many laws related to public-private relations; develop the Law on Management and Use of State Capital Invested in Production and Business at Enterprises (amended) to remove difficulties and free up resources for development, especially in difficult times.

For draft laws that are not yet included in the 2025 law and ordinance building program and plan, they will be summarized during the law review process to study and handle them according to legal regulations.

Along with that, the Prime Minister continued to review and identify urgent shortcomings and obstacles, institutional "bottlenecks" that need to be removed to facilitate production and business of people and enterprises, ensuring the goals of promoting growth, controlling inflation and stabilizing the macro-economy in accordance with the requirements, tasks and directions of the Government.

Along with law making, promptly develop and issue decrees guiding the implementation of laws to organize timely and effective enforcement of laws.

The Prime Minister assigned the Ministry of Justice to advise on the personnel restructuring of the Steering Committee in accordance with the Steering Committee's operating regulations; at the same time, continue to synthesize the situation of document processing after review and review results from ministries, ministerial-level agencies and localities; coordinate with ministries and ministerial-level agencies to study and evaluate the review results, and report to the Steering Committee for consideration and decision.

To ensure the objectivity, comprehensiveness and accuracy of the review results, and to ensure adequate basis for advising the Steering Committee, the Standing Body of the Steering Committee needs to flexibly organize conferences, seminars, and consult experts and scientists in the reviewed legal fields in accordance with legal regulations, especially on issues with different opinions between the recommending agency and the Ministry or ministerial-level agency in charge of state management.

The Prime Minister assigned Deputy Prime Minister Le Thanh Long, Permanent Deputy Head of the Steering Committee, to continue directing the Ministry of Justice and relevant ministries and branches to perform tasks within the scope of responsibility of the Steering Committee, and report to the Prime Minister and Head of the Steering Committee according to regulations.
