Dung and the two subjects Nguyen Quang Phong (born in 2004), N.D.HL (born in 2010), both residing in Thanh Ha district, knew each other before. On the morning of August 19, Dung and L. were at the internet cafe "Tuoi game" in Tien Trung area, Ai Quoc ward (Hai Duong city) when Nguyen Thanh Sang (born in 2007, residing in Cong Hoa commune, Nam Sach district) entered the cafe to play.

Dung discovered that Sang left a black Xiaomi Redmi Note 12 phone on the table and had the idea of ​​taking it and selling it for money. Dung came up with a plan to steal the phone and discussed with L. to invite Phong to join. L. agreed with Dung.

Seeing that Sang was about to leave, Dung asked Sang to give him a ride. Sang agreed to take Dung on an electric motorbike. He sped off on a motorbike carrying L. and followed behind. When they reached the 789 overpass on Highway 5, Dung threatened Sang, forcing him to give him his phone or he would kill him.

Mr. Sang was scared and gave the phone to Dung. At this time, Dung held the phone to his ear so that P. and L. could see, and walked up from behind to approach Dung's car. Dung gave the phone to L, then Phong drove L. forward. Mr. Sang drove Dung to the opposite of Quyet Thang gas station, then stopped for Dung to get off the car. Mr. Sang rode his electric motorbike and ran away, while Dung walked to the Tien Trung intersection to meet Phong and L.

All three subjects went to Dang Khoa phone store in Dong Lac commune (Nam Sach) to sell the phone for money, then divided the money to spend.

Dung has a previous conviction for theft of property.
