After a long period of review and balancing, the problem of adjusting the allocation of indicators (PBCT) of some types of provincial land to suit the socio-economic development situation has now been solved.
Some localities are allowed to increase residential land area for projects with high motivational value.
This is the basis for localities to complete adjustments to land use plans and planning according to regulations, and at the same time update information into provincial planning.
Review and adjust
In March 2022, the Prime Minister issued Decision No. 326/QD-TTg on the approval of the national land use planning for the 2021-2030 period, with a vision to 2050, and the 5-year national land use plan for 2021-2025. On this basis, in May 2022, the People's Committee of Hai Duong province issued Decision No. 1404 approving the principles, criteria, and priority order of approval of some types of provincial-level land and Decision No. 1411/QD-UBND on approval of some types of provincial-level land to adjust the district-level land use planning for the 2021-2030 period and the implementation period of 2021-2025 in the province. After this decision, the implementation of related tasks has encountered a number of difficulties and inadequacies.
According to the reporter's investigation, regarding the industrial park land index, at the time the competent authority advised the province to allocate land, Hai Duong was proposing the Government to allow the establishment of a specialized economic zone in the two districts of Thanh Mien and Binh Giang with a scale of about 10,000 hectares. At that time, the province had not allocated land for the industrial park for Thanh Mien district. However, currently, the project to establish a specialized economic zone has not been allocated land by the Government for implementation.
Besides, the allocated industrial park land area in Thanh Ha district is 125 hectares, lower than the area approved by the Prime Minister (400 hectares).
Regarding the industrial cluster land target, at the time of land allocation, in addition to the 33 industrial clusters established before 2017, there were 25 new industrial clusters in the province. Of these 25 new industrial clusters, only 3 had their detailed planning approved by the Provincial People's Committee, the remaining 22 had their establishment decisions, so the Provincial Party Standing Committee agreed to allow land allocation for each of these industrial clusters to be 15 hectares. However, this allocation will make it difficult for investors to complete land and environmental procedures and will not ensure the implementation of synchronous infrastructure construction. On the other hand, currently, some industrial cluster investors have actively implemented the procedures, so some industrial clusters need to be prioritized for land allocation for implementation.
Regarding the allocated residential land quota, during the process of reviewing and consulting on the adjustment plan for the general urban planning and district planning, the Department of Construction found that the residential land quota of some localities such as Hai Duong City, Chi Linh City, and Kinh Mon Town was larger than the permitted construction planning standards.
Faced with this reality, the Provincial People's Committee has requested relevant departments, branches and sectors to coordinate with localities to focus on reviewing, advising and proposing adjustments and supplements to principles, criteria and priority orders for PBCT of some types of land in accordance with the situation and needs of socio-economic development of the province.
Difficult problem
According to the Department of Natural Resources and Environment, adjusting the allocation quota for some types of provincial land is not an easy task. The reason is that the allocated land quota is limited, while the demand for use for socio-economic development of localities is very large. Reducing some types of land in one locality to supplement other localities and adjusting this type of land to supplement other types of land must be calculated specifically and carefully, in order to maximize the efficiency of land use, while ensuring the development goals of each locality, creating a breakthrough momentum for socio-economic development of the province.
The Provincial People's Committee has directed to review, collect opinions, and agree on the adjustment plan. The Party Committee of the Provincial People's Committee has reported to the Standing Committee of the Provincial Party Committee for consideration and comments. In the Conclusion Notice No. 866-TB/TU dated December 14, 2022 and 904-TB/TU dated January 4, 2023, the Standing Committee of the Provincial Party Committee has directed, noting that the adjustment of the PBCT of land types must ensure compliance with Decision No. 326 of the Prime Minister. Prioritize the allocation of land area for industrial parks and industrial clusters approved by competent authorities, assign investors with sufficient conditions and capacity to implement, and divide into specific stages for each stage. For industrial park land, initially allocate to 23 industrial parks approved by competent authorities and industrial parks in specialized economic zones. For residential land, it is necessary to prioritize the arrangement and allocation of sufficient area for large-scale, high-value projects, creating development momentum for the province...

On January 17, the Provincial People's Committee issued a decision approving the adjustment of the allocation targets of some provincial-level land types to adjust the district-level land use planning until 2030 and the implementation period 2021-2025 in Decision No. 1411. Accordingly, the land area of Thanh Ha Industrial Park was increased by 25 hectares, and the expanded Cong Hoa Industrial Park (Chi Linh) was added with 40 hectares. Thanh Mien Industrial Park 1 and 2 were allocated 400 hectares of land. Some industrial parks were transferred to the period after 2030 to supplement the area for the above industrial parks. The land area of industrial parks in the period 2021-2025 was adjusted down by 150 hectares to supplement the residential land area target for large-scale projects with high motivational value in Thanh Ha, Gia Loc, Nam Sach districts, Hai Duong city, etc.
According to Director of the Department of Natural Resources and Environment Hoang Van Thuc, based on the approved adjustment, localities will base on land use indicators, list of projects and works allocated by the province to adjust and complete the land use planning dossier until 2030 and land use plan according to regulations. The land allocation indicators will be updated by competent authorities into the planning of Hai Duong province until 2030, vision to 2050 and 5-year land use plan (2021-2025).
