Discussing in groups about amending and supplementing a number of articles of 4 laws, delegate Nguyen Ngoc Son (Hai Duong) proposed clarifying the difficulties and inadequacies in the current legal system.
Participating in the discussion in the group, delegate Nguyen Ngoc Son, National Assembly Delegation of Hai Duong province agreed with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on Planning, the Law on Public Investment, the Law on Investment under the form of public-private partnership and the Law on Bidding. The delegate said that the content of the draft law is consistent with the Party's policies and guidelines, and agrees with the legal, political and practical bases in the Government's Submission No. 675/TTr-CP.
However, since this law was issued to address urgent practical needs, it is recommended that the drafting agency clarify the difficulties and inadequacies in the current legal system that have been specifically resolved in which articles and clauses in the draft law, ensuring that the policies issued are feasible, effective and appropriate. It is recommended that the drafting agency continue to research and supplement regulations to ensure full and comprehensive institutionalization of guiding viewpoints, contributing to addressing current limitations and inadequacies.
However, the submission time is too urgent (the 8th Session opens on October 21, but the Government only submitted the submission and documents to the National Assembly on October 18). Thus, it is very difficult to ensure the correct implementation of the processes and procedures in law-making, collecting opinions as well as ensuring the quality of the draft law. It is recommended that it be carefully considered so that it can be passed in one session.
Currently, the Government is amending and supplementing a number of draft laws, including the draft Law on Geology and Minerals and the Law on Electricity. The draft laws all add provisions related to planning, investment, transitional regulations, etc. that are different from the provisions of current laws. Therefore, it is recommended that the Government direct relevant agencies to review to ensure consistency and uniformity of the legal system. At the same time, it is recommended that the drafting agency review the entire draft law, ensuring strict compliance with Regulation No. 178-QD/TW dated June 27, 2024 of the Politburo on controlling power, preventing and combating corruption and negativity in law-making.
