According to the Ministry of Planning and Investment, the amendment aims to resolve urgent difficulties and problems in practical implementation related to planning, investment and bidding.
On October 30, the National Assembly continued to work on many contents related to the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model, the Law on Bidding, and the Law on People's Air Defense.
Specifically, the Minister of Planning and Investment, authorized by the Prime Minister, will present a report on the draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.
The Chairman of the National Assembly's Economic Committee will present a report examining these draft laws.
The Ministry of Planning and Investment said that this draft law aims to amend and supplement a number of provisions of four current laws, including: the Law on Planning, the Law on Investment under the public-private partnership model, the Investment Law and the Law on Bidding.
The purpose of developing this draft law is to resolve urgent difficulties and problems in practical implementation related to planning, investment and business activities, investment under the public-private partnership model and bidding activities, while simplifying administrative procedures, increasing decentralization and delegation of power to localities, along with strengthening inspection and supervision.
The draft proposes eight policies: One is to perfect regulations on the national planning system, the relationship between types of planning and funding for planning activities to ensure consistency and unity of planning laws.
Second, perfect regulations on content, implementation plans and planning adjustments to ensure simplification of administrative procedures and increase decentralization and delegation of power to localities.
Third, continue to strengthen the decentralization of authority to approve investment policies to the provincial People's Committee for projects on construction and business of infrastructure of industrial parks and export processing zones; new construction investment projects; ports; port areas with investment capital of VND 2,300 billion or less belonging to special seaports.
Fourth is to handle some problems arising from practice related to appraisal and approval of investment policies for urban planning and termination of investment projects.
The fifth is to expand and diversify the fields, forms and methods of implementing PPP projects, perfect the financial mechanism for PPP projects to maximize resources from the private sector, and ensure the leading role of public investment.
Sixth is to simplify procedures, promote decentralization of state management of PPP projects, facilitate investment preparation, and speed up project implementation progress.
Seven is to completely resolve difficulties and obstacles for transitional BOT and BT projects.
Eight is to handle some practical problems arising from the process and procedures for implementing bidding activities and to increase decentralization in deciding on bidding contents.
Next, the National Assembly deputies will listen to the Chief Prosecutor of the Supreme People's Procuracy present a report on the draft Resolution on piloting the handling of evidence and assets during the investigation, prosecution and trial of a number of criminal cases. The National Assembly deputies will discuss in groups the above two contents.
At the afternoon session, a member of the National Assembly Standing Committee and Chairman of the National Assembly's Committee on National Defense and Security will present a report explaining, accepting, and revising the draft Law on People's Air Defense.
Next, the National Assembly will discuss in the hall a number of contents of this draft law that still have different opinions.
