On the afternoon of December 29, at the Government headquarters, chairing the 4th meeting of the Steering Committee for reviewing and organizing the implementation of handling difficulties in the legal system (Steering Committee), Prime Minister Pham Minh Chinh, Head of the Steering Committee, requested to abandon the mindset of banning if you can't manage, and managing if you don't know; thoroughly grasp the mindset of assigning whoever can manage best, and not doing what people and businesses do well; putting what is banned into law, and creating space for creativity if it is not banned...
Also attending the meeting were: Deputy Prime Minister Le Thanh Long, Deputy Head of the Standing Committee; Deputy Prime Minister, Minister of Foreign Affairs Bui Thanh Son; ministers, heads, leaders of ministries, ministerial-level agencies as Deputy Heads and members of the Steering Committee.
The meeting focused on discussing and giving opinions on handling difficulties in the system of legal documents in the legal fields of decentralization, delegation of authority, and authorization. In particular, reviewing legal documents affected by organizational and apparatus arrangements; exchanging and discussing a number of other issues related to the implementation of the Steering Committee's tasks.
According to the Ministry of Justice, to date, 22 ministries and ministerial-level agencies have reviewed legal documents and found that more than 5,000 documents are directly affected by the organizational restructuring. Of these, more than 2,800 documents are related to changes in the names of agencies, organizations and units; nearly 1,900 documents have content that needs to be processed immediately and more than 300 documents have content that needs to be processed but is not urgent.
According to the Ministry of Home Affairs, the laws on decentralization, delegation of power, and authorization are mainly stipulated in the Law on Organization of the Government (amended); the draft Law on Organization of Local Government (amended) and a number of specialized laws. Through review, it was determined that there are more than 1,000 legal documents with content related to the above two laws.
In particular, there is still a situation of direct decentralization to ministries and branches in specialized laws; regulations for the Government and the Prime Minister to decide on many specific issues; it is necessary to consider the consistency and unity of the legal system on this issue...
The Steering Committee members proposed to amend and supplement legal documents to have a full legal basis for the reorganization of the apparatus, avoid legal gaps and ensure all normal, uninterrupted activities of agencies, organizations, units, people and enterprises when implementing the reorganization of the apparatus.
Along with that, amending the regulations related to decentralization, delegation of power, and authorization ensures a clear legal system, creating a legal basis and space for creativity and development. At the same time, encouraging daring to think, daring to do, daring to take responsibility and in the spirit of "local decision, local action, local responsibility"; aiming at the goal of innovation, streamlining and organizing the state administrative apparatus to be streamlined, strong, efficient, effective, and efficient.
Concluding the meeting, the Prime Minister highly appreciated the dedicated, responsible, practical, profound and quality opinions of the Deputy Prime Ministers, members of the Steering Committee and delegates attending the meeting. At the same time, he acknowledged the effectiveness of the Steering Committee's activities after 4 meetings, reviewing current legal regulations, as a basis for advising on the completion of legal documents, including the Government submitting to the National Assembly for consideration and approval of 3 laws, amending 13 laws to remove difficulties and obstacles in the fields of planning and investment, finance at the 8th Session of the 15th National Assembly, promoting growth, controlling inflation and stabilizing the macro economy, deploying wind power, solar power... bringing practical benefits to people and businesses, freeing up resources for the country's development.
The Prime Minister welcomed the initiative on applying digital technology, especially the application of artificial intelligence and databases in receiving and processing feedback and recommendations from people and businesses in drafting legal documents and handling arising problems. At the same time, he requested the prompt issuance of documents to serve the restructuring of the apparatus to ensure it is streamlined, strong, efficient, effective and efficient; not to interrupt operations during the restructuring process, including urgently studying and submitting to the National Assembly a resolution assigning the Government to issue documents to cover the scope and subjects of principle in order to supplement and amend issued documents related to this issue.
The Prime Minister also directed to promptly submit to the Government the draft Law on Government Organization (amended); the draft Law on Local Government Organization (amended); the draft Law on Promulgation of Legal Documents (amended); and the Law on Management and Use of State Capital Invested in Production and Business at Enterprises to submit to the National Assembly according to a shortened process.
The Prime Minister emphasized that we must abandon the mindset of banning what we can't manage, and managing what we don't know; at the same time, we must thoroughly grasp the mindset of assigning whoever can manage best, and not doing what people and businesses do well; the State only focuses on state management, building strategies, planning, promoting development creation and designing tools for inspection and supervision; what is prohibited is put into law, what is not prohibited is created space for creativity...
The head of the Government emphasized the need for decentralization and delegation of power, along with resource allocation and improving implementation capacity, with the motto "locality decides, locality acts, locality takes responsibility," "clearly assigns people, clear tasks, clear time, clear responsibilities, clear products," focusing on removing obstacles and unblocking all resources, focusing on double-digit growth in the following years.
The Prime Minister directed ministries and agencies to urgently review and promote decentralization in specialized laws that stipulate the Prime Minister's authority to approve investment policies, approve investments, adjust and transfer projects to remove obstacles in investment procedures for projects in these fields.
Ministries and branches, within the scope of their functions and tasks, continue to proactively review, research, develop, amend and supplement legal documents affected by the organizational arrangement, not leaving legal gaps in the process of implementing new tasks.
The Prime Minister said that in addition to the laws and resolutions to be submitted to the National Assembly at the 9th Extraordinary Session, the law and ordinance building program for 2025 is also very heavy, including projects already included in the law and ordinance building program for 2025 and new projects proposed by ministries and branches to be added in 2025 to carry out new tasks on organizational structure and tasks assigned by competent authorities, with an expected 49 draft laws, ordinances and resolutions.
To ensure quality and feasibility in the process of preparing draft laws, ordinances and resolutions, the Prime Minister assigned ministries and ministerial-level agencies to proactively and urgently coordinate with the Ministry of Justice to research and report to the Government for consideration and decision to submit to the National Assembly and the National Assembly Standing Committee.
The Deputy Prime Ministers monitor and direct relevant sectors and ministers to urgently complete and submit to the Government and the Prime Minister the Decree on investment support; Ho Chi Minh City Planning for the 2021-2030 period, with a vision to 2050; on credit room of banks lending for social housing development... The Prime Minister assigned Deputy Prime Minister Le Thanh Long, Deputy Head of the Standing Committee, to continue directing the Ministry of Justice and relevant ministries and sectors to perform tasks within the scope of responsibility of the Steering Committee, and report to the Prime Minister and Head of the Committee according to regulations.
