The People's Procuracy of Hai Duong province has prosecuted former Chairman of the Hai Duong Provincial Labor Federation Mai Xuan Anh for the crime of lack of responsibility causing serious consequences as prescribed in Point c, Clause 3, Article 360 of the Penal Code.
Along with Mr. Mai Xuan Anh, two former officials of the Hai Duong Provincial Labor Federation were also prosecuted, including: Pham Thi Thuy Linh was prosecuted for the crime of taking advantage of position and power while performing official duties as prescribed in Clause 3, Article 356 of the Penal Code; Nguyen Van Nam was prosecuted for the crime of lack of responsibility causing serious consequences as prescribed in Point c, Clause 3, Article 360 of the Penal Code.
According to the investigation conclusion, from 2017 to 2022, Pham Thi Thuy Linh was the Head of the Finance Department of the Hai Duong Provincial Federation of Labor. In the process of performing her duties, in order to allow grassroots unions to proactively use union finances and to fulfill her own union financial tasks, Linh advised Mai Xuan Anh, then Chairman of the Hai Duong Provincial Federation of Labor, to sign a document instructing grassroots unions in the production and business sector to collect union funds and pay them to the Hai Duong Provincial Federation of Labor, contrary to regulations; intentionally adjusting the amount of funds to be paid to the amount of funds already paid for grassroots unions in 5 enterprises in the province.
From 2017 to April 2022, defendant Mai Xuan Anh, Chairman of the Hai Duong Provincial Federation of Labor, did not fully perform his duties and responsibilities in inspecting his subordinates when signing instructions on decentralizing collection for grassroots unions in the production and business sectors and in urging and inspecting the activities of the Finance Department of the Hai Duong Provincial Federation of Labor.
From 2017 to 2022, Nguyen Van Nam did not properly fulfill his responsibilities as Chairman of the Inspection Committee of the Hai Duong Provincial Federation of Labor when he signed a document instructing the grassroots trade union of an enterprise in the province to collect and pay trade union fees to the Hai Duong Provincial Federation of Labor; did not fully fulfill his responsibilities when concluding inspections and supervising and urging the implementation of peer-to-peer inspection activities at the Hai Duong Provincial Federation of Labor.
The defendants’ actions caused the Hai Duong Provincial Labor Federation to lose a total of more than VND20.5 billion due to failure to collect sufficient union fees as required by the regulations of five grassroots unions. To date, nearly VND12.6 billion has been recovered, of which defendant Mai Xuan Anh paid VND300 million.
Regarding the case of Abusing position and power while performing official duties; Lack of responsibility causing serious consequences occurring at the Hai Duong Provincial Labor Federation, 10 grassroots union officials at 5 enterprises were investigated and prosecuted for the crimes of embezzlement of property and abuse of position and power while performing official duties.
On March 6, 2024, the People's Court of Hai Duong province held a first-instance trial of Mai Xuan Anh (born in 1969, residing in Ngoc Chau ward, Hai Duong city, former Chairman of the Provincial Labor Federation) and two other officials of the Hai Duong Provincial Labor Federation for embezzlement. Mr. Mai Xuan Anh was sentenced to 5 years and 6 months in prison.
