The Ministry of Public Security has concluded the second phase of the investigation into the case at Van Thinh Phat Group, SCB and related units; proposed to prosecute Ms. Truong My Lan and 33 defendants.
On June 5, the Police Department investigating crimes of corruption, economy, and smuggling (C03), Ministry of Public Security, announced that it had proposed to prosecute the defendants for 3 crimes.Fraudulent appropriation of property, Money laundering, Illegal transportation of currency across borders, according to Articles 174, 324 and 189 of the Penal Code.
C03 has notified SCB Bank and related units, organizations and individuals who are victims, litigants, and their rights and interests protectors of the conclusion of the investigation of this case.
Previously, in December 2023, at a press conference of the Ministry of Public Security, Major General Nguyen Van Thanh, Deputy Director of C03, said that in the act ofMoney laundering, Ms. Lan is suspected of using criminal proceeds to invest in real estate, buying up large real estate projects. "We also determined that there was money transferred abroad for investment, so we have commissioned an investigation through judicial activities," Mr. Thanh said.
In behaviorFraudulent appropriation of property, Ms. Lan and her accomplices were accused of issuing 25 bonds worth more than 30,000 billion VND through 3 Van Thinh Phat companies. During the investigation, the police had difficulty identifying the victims. Therefore, the Ministry of Public Security repeatedly requested that the victims who bought 25 bonds from Van Thinh Phat contact the investigation agency in their place of residence to report and ensure their rights.
The case at Van Thinh Phat Group is very large and complicated, with a large number of defendants, so the Ministry of Public Security had to separate it into two investigation phases.
In the initial phase, Ms. Truong My Lan was accused of directing her accomplices to disburse a total of more than 2,500 loans to a group of companies in the Van Thinh Phat Ecosystem during the 10 years of acquiring SCB. By October 2022, Ms. Lan and Van Thinh Phat's group still had nearly 1,300 loans with an outstanding principal and interest of VND 677,000 billion.
On April 11, Ho Chi Minh City People's Court sentenced Ms. Lan to 20 years in prison for the crime ofBribery; 20 years in prison for the crimeViolation of regulations on lending in the operations of credit institutionsand death penalty for the crimeEmbezzlement of property. Total punishment, the defendant must serve the death sentence.
In relation to the case, Ms. Do Thi Nhan (former Director of the State Bank's Inspection and Supervision Department) was sentenced to life in prison by the Ho Chi Minh City People's Court for the crime ofTake bribes, amounting to 5.2 million USD. 3 former leaders of SCB including Dinh Van Thanh, Bui Anh Dung, former chairman of SCB and Vo Tan Hoang Van, former general director of SCB were sentenced to life in prison. 81 other defendants were sentenced from 3 years suspended sentence to 20 years in prison.
The judgment also determined that, with the assets and money to remedy and ensure the obligations for the defendant Lan in the entire case (including this case and the cases of phase two), priority will be given to the execution of the judgment for the victims related to the act.Fraudulent appropriation of propertyin issuing bonds.
