Deputy Prime Minister Tran Hong Ha noted that it is necessary to carefully calculate regulations on exemption and reduction of land use fees for attracting investment projects, including transitional cases.
On the afternoon of June 11, at the Government headquarters, Deputy Prime Minister Tran Hong Ha chaired a meeting with ministries, branches, agencies, associations, experts and connected online with 63 provinces and cities nationwide on the draft Decree regulating compensation, support, and resettlement when the State reclaims land; on land prices; land use fees, and land rents.
According to the report of Mr. Dao Trung Chinh, Director of the Department of Planning and Land Resources Development, Ministry of Natural Resources and Environment, the draft Decree regulating compensation, support, and resettlement when the State reclaims land, includes 3 chapters and 32 articles.
The draft Decree has reviewed and clarified the scope of regulation; supplemented the content on compensation, support and resettlement plans; subjects whose residential land is recovered and compensated with land for other purposes are Vietnamese people residing abroad who are using residential land and owning houses attached to land use rights in Vietnam; the land price for calculating land use fees when allocating land for purposes other than residential land to these subjects is the land price in the land price list.
The draft Decree supplements regulations on handling cases where subjects have residential land recovered (for a stable, long-term period) but are compensated with land other than residential land (land lease with one-time payment); cases where due to natural disasters, landslides, subsidence, at the time of making the plan, the area of the measured land plot is changed compared to the area recorded on the certificate or prescribed documents...
In addition, supplement and amend regulations on compensation for agricultural land areas that have been used stably before July 1, 2004, where the land users are households and individuals directly engaged in agricultural production but do not meet the conditions for granting Land Use Right Certificates; agricultural land areas due to receiving land use right transfers exceeding the limit before July 1, 2014, etc.
Taking note of the comments at the meeting, the Deputy Prime Minister requested the drafting agency to study, absorb, review and fully explain the comments, including adding regulations on the use of social housing to serve compensation and resettlement work; in case of land recovery, assets attached to land are public assets...
Regarding the draft Decree regulating land prices, after receiving comments, it is noteworthy that the Ministry of Natural Resources and Environment agreed not to stipulate the number of projects to survey and collect information on business prices of products and services to ensure consistency with the survey and collection of information on transfer prices, land rental prices, and premises rental prices.
The determination of estimated transfer prices, land rental prices, premises rental prices, and business prices of referenced products and services is carried out using the comparison method.

Requesting to prioritize the completion of the draft Decree on land prices, the Deputy Prime Minister assigned the Ministry of Natural Resources and Environment to absorb expert opinions to strictly regulate the calculation of construction investment costs and other financial items according to the law on construction.
The Ministry of Natural Resources and Environment reviews and has full management regulations for regulations on operating conditions and establishes a database on organizations and individuals practicing land valuation... from training, certification, public announcement, database establishment and violation handling mechanism.
According to the report of the Ministry of Finance on the draft Decree on land use fees and land rent, the principle of exemption from land use fees and land rent is that the State allows land users not to pay land rent for the entire period of land use. Reducing land rent is that the State allows land users not to pay an amount calculated as a percentage of the land rent.
The Ministry of Finance shall rebalance some exemption and reduction levels of land rent and have transitional regulations for other cases of exemption and reduction of land use fees and land rents according to the provisions of the Land Law; propose options for calculating the amount of money that land users must pay additionally for the period when land use fees and land rents have not been calculated based on the amount of land use fees and land rents payable.
The Ministry of Finance has proposed a plan to exempt and reduce land use fees and land rent for investment projects in the form of public-private partnerships. The method of calculating the unit price for annual land rent payment has received opinions from many ministries, branches and localities; the rate of calculating the unit price for land rent according to the land price list has been adjusted down so that localities can be proactive in implementation.
Regarding the draft Decree on land use fees and land rents, delegates focused on clarifying the provisions on the principles of exemption from land use fees and land rents and reduction of land use fees and land rents; options on land rent unit prices; exemption and reduction of land use fees and land rents for investment projects in the form of public-private partnerships; levels of land rent exemption and reduction; debt recording of land use fees, etc.
Regarding this issue, Deputy Prime Minister Tran Hong Ha noted that it is necessary to carefully calculate regulations on exemption and reduction of land use fees for attracting investment projects, including transitional cases.
Regarding the regulation on the amount of money that land users must pay in addition to the time when land use fees and land rents have not been calculated, the Deputy Prime Minister agreed with the principle of sharing responsibility between the State and land users. Because according to localities, in reality, it is difficult to determine the fault of the delay in determining land prices, but it is not fair to cases where land use fees and land rents have been determined and notified but payment has been delayed.
The Deputy Prime Minister assigned the Ministry of Natural Resources and Environment to coordinate with the Ministry of Finance to supplement the procedures for regulations related to land fund development organization and land use fee debt recording in cases where land use right certificates are granted for the first time.
