On December 5, the Investigation Police Agency of Tu Ky District Police (Hai Duong) prosecuted defendant Vu Duc Binh for the crime of resisting a person on official duty.
On the evening of November 29, as planned, the Tu Ky District Police Working Group patrolled, controlled and set up a checkpoint to check alcohol concentration at km 10+750 of Provincial Road 391 in Dai Son Commune. At around 8:30 p.m., the checkpoint discovered Vu Duc Binh (born in 1971, residing in Dai Son Commune, Tu Ky) riding a motorbike from Hai Duong City to Tu Ky Town showing signs of alcohol use, so they immediately signaled him to stop the vehicle for an alcohol test. Binh did not comply with the order and "passed the checkpoint".
Traffic police officers on duty at the checkpoint chased and stopped Binh's car at gas station No. 38, Hung Dao commune (Tu Ky). Here, the task force propagandized, mobilized and asked Binh to comply with the alcohol concentration test. Binh did not comply, parked the car and went into the gas station's restroom.
When he came out, Binh shouted, challenged, argued, and hit a traffic police officer in the face with his motorbike helmet, causing minor injuries. Immediately, the law enforcement force restrained Binh.
The police then tested and discovered that Binh had a breath alcohol concentration of 0.741 mg/l.
