Resisting law enforcement officers

Who are public servants? They are cadres, civil servants, public employees; cadres and soldiers of the armed forces... assigned to perform duties and exercise powers according to regulations and protected by law to serve the interests of the State, people and society.

In recent times, many officers and soldiers have faced danger, many comrades have bravely sacrificed themselves in fighting floods and storms, fighting fires, preventing crime, ensuring security and order... leaving behind young wives and children, very sad and heartbroken.

However, the situation of resisting law enforcement officers is becoming more complicated with dangerous nature and level in many areas, especially in ensuring security and order, traffic safety, land management, site clearance, handling complaints and denunciations, managing import and export activities in border areas, fighting and preventing crime...

In Hai Duong City, on the evening of October 7, on Truong Chinh Street, Nguyen Duc Hieu (born in 2005, residing in Khanh Hoi residential area, Nam Dong ward) was riding a motorbike without a helmet, had been drinking alcohol, and deliberately swerved to escape when the Hai Duong City Police task force stopped his vehicle to check and handle violations of alcohol concentration. While intoxicated, Hieu drove his motorbike into Lieutenant Colonel Dang Xuan Hoan, Captain of the Criminal Police (Hai Duong City Police) who was in command here, seriously injuring Hoan and requiring emergency treatment. On October 10, Hieu was prosecuted for investigation of the crime of resisting a person performing official duties.

Previously, at around 1:00 p.m. on April 28, in Chi Linh City, Vu Quoc Viet (born in 1988) brought two knives to the house of Ms. Kh.TQ (born in 1988, also residing in Pha Lai Ward) to curse, insult, and threaten to slash Ms. Q's husband. When the working group of the Ward Police entered Ms. Q's house and asked Viet to go to the Ward Police headquarters for questioning, Viet continuously cursed, spat, and punched two police officers. In early August, Viet was sentenced to 11 months in prison for resisting a person performing official duties.

In addition to the cases of resisting law enforcement officers that have been prosecuted and tried, a number of other cases have also been very reckless, challenging the authorities.

The above acts of using force, threatening to use force, failing to obey orders or obstructing people performing official duties; and then challenging competent authorities affect the maintenance of law and order, causing serious damage to the life, health, and honor of people performing official duties and the interests of the people.

​Acts of resisting law enforcement officers demonstrate contempt for the law, negatively impact security, order, and social safety; and obstruct the proper functioning of authorities. The crime of resisting law enforcement officers is clearly defined in Article 330 of the 2015 Penal Code (amended and supplemented in 2017).

The main causes of this behavior are lack of knowledge, lack of self-control due to the use of stimulants, disregard for the law... There are cases of intentionally obstructing or resisting law enforcement officers to avoid being punished. In addition, at times and in some places, law enforcement officers have limited sense of responsibility and working style, and even their analysis and resolution of violations are not thorough and scientific, which can cause frustration or lead to "lawlessness"...

To prevent cases of resisting law enforcement officers, it is necessary to first strengthen propaganda, education, and dissemination of the law to the people. Handle violations strictly, with sufficient deterrence. Take proactive measures to prevent, stop, and handle acts of resisting law enforcement officers in various fields...
