Hai Duong is the first province to issue detailed documents to implement the 2024 Land Law.
As of March 18, the People's Council and People's Committee of Hai Duong province have issued 14 documents detailing the implementation of the 2024 Land Law and decrees detailing and guiding the implementation of this law. Of these, there are 4 resolutions issued by the Provincial People's Council and 10 decisions approved by the Provincial People's Committee.
Contents of resolutions and decisions on amending and supplementing a number of contents of the land price list for the period 2020-2024 in Hai Duong province; land policies for ethnic minorities in ethnic minority and mountainous areas in the province; detailed regulations on a number of articles and implementation measures on compensation, support, and resettlement when the State recovers land in the province; regulations on land allocation limits, limits on recognition of residential land, limits on receiving transfer of agricultural land use rights; conditions for land division and land consolidation; minimum area allowed for land division and land consolidation; regulations on criteria for deciding to conduct bidding to select investors to implement investment projects using land in accordance with the actual situation of the locality...
There are 6 remaining legal documents that have not been issued. Of which, 2 documents are being submitted to the Provincial People's Committee for consideration and promulgation, including: Detailed regulations on a number of contents of Decree No. 102/2024/ND-CP dated July 30, 2024; regulations on receiving, transferring records, returning results of handling administrative procedures on land in the province, implementation time of each agency and unit.
1 document on the regulations for coordinating the implementation of functions, tasks and powers between the Provincial Land Fund Development Center, the District Land Fund Development Center with the competent land management agency, the financial agency and other relevant agencies and units in the locality is expected to be consulted and issued after the Provincial People's Committee arranges and reorganizes the Land Fund Development Center into a public service unit under the Provincial People's Committee, decides on the establishment of Land Fund Development Centers in districts, towns and cities (if any) according to the provisions of the Land Law.
1 document regulating the authority, process of preparing, synthesizing, approving plans and deciding on capital advances from the Land Development Fund is expected to be issued after the Provincial People's Committee completes the Land Development Fund.
2 documents under draft include: Prices for providing remaining public services in registration procedures, granting certificates, handling money from selling land use right auction documents, remaining costs for organizing land use right auctions, economic-technical norms, unit prices for implementing land use plan preparation; regulations on area, location, and purpose of construction works directly serving agricultural production on rice-growing land.
The 2024 Land Law takes effect from August 1, 2024, of which 20 contents are assigned to local authorities to issue detailed regulations for implementation. Hai Duong is assessed by the Government as one of the very few localities that have promptly issued documents guiding the implementation of the 2024 Land Law.
