New proposal of the Ministry of Public Security on granting electronic identification accounts to children

In the draft decree of the Government regulating electronic identification and authentication, the Ministry of Public Security has added regulations on granting electronic identification accounts to children.

The Ministry of Justice is reviewing the draft Government decree regulating electronic identification and authentication developed by the Ministry of Public Security.

Accordingly, this draft decree details a number of articles of the Law on Identification and the responsibilities of relevant agencies, organizations and individuals regarding identification, electronic authentication and electronic identification.

Expected detailed regulations on granting electronic identification accounts to children

Notably, the new draft decree has added regulations on granting level 1 electronic identification accounts and level 2 electronic identification accounts for people under 6 years old, from 6 years old to under 14 years old, and over 14 years old.

Specifically, the draft stipulates that Vietnamese people aged 6 years and older who have been granted an ID card will be granted a level 1 electronic identification account and a level 2 electronic identification account.

Citizens under 6 years old have been granted ID cards and level 1 electronic identification accounts.

In addition, foreigners entering Vietnam under 6 years old are granted a level 1 electronic identification account, from 6 years old and up are granted a level 1 electronic identification account, level 2 electronic identification account.

Procedures for issuing electronic identification accounts

Draft decree regulating the procedures for granting electronic identification accounts to Vietnamese people at levels 1 and 2.

For level 1, People using mobile devices download and install the national identification application.

People use the national identification application to enter information about personal identification number, mobile phone number, email address (if any); declare information according to instructions on the national identification application.

Collect facial photos via mobile devices (applicable to people aged 6 and over) and send a request for an electronic identification account to the electronic identification and authentication management agency.

The electronic identification and authentication management agency checks and authenticates the information of people requesting an electronic identification account and notifies the account registration results via the national identification application or via the owner's mobile phone number or email address.

Representatives and guardians use their own mobile phone number and their level 2 electronic identification account to declare and register for a level 1 electronic identification account for Vietnamese people under 14 years old, wards, and representatives through the national identification application.

For level 2, The draft stipulates that people go to the police station of the commune, ward, or town or the place where they apply for an ID card to apply for a level 2 electronic identification account.

Citizens present their ID cards, provide their mobile phone number, citizen email address (if available) and request to integrate information into their electronic ID cards if needed.

The receptionist enters the information provided by the citizen into the electronic identification and authentication system; authenticates the face photo and fingerprint of the citizen coming to do the procedure with the identification database. The citizen signs and confirms the registration to create a level 2 electronic identification account.

The electronic identification and authentication management agency checks and authenticates the information of people requesting a level 2 electronic identification account and notifies the results of the registration for a level 2 electronic identification account via the national identification application or the owner's mobile phone number or email address.

People from 6 years old to under 14 years old, persons under guardianship, persons under representation, together with their representatives or guardians, must go to the police station of the commune, ward, town or the place where the ID card issuance procedures are carried out to carry out the procedures for issuing a level 2 electronic identification account.

Representatives and guardians use their own mobile phone numbers to declare and register for level 2 electronic identification accounts for Vietnamese citizens who are from 6 to under 14 years old, wards, and representatives.

In case of not being granted an identity card, make a request for an electronic identification account at the same time as carrying out the identity card issuance procedure.
