The new draft circular of the Ministry of Home Affairs has added regulations on the structure of civil servant ranks of units using civil servants under ministries, ministerial-level agencies, and localities.
The Ministry of Home Affairs is consulting with agencies and localities on the drafting of a circular amending and supplementing a number of articles of Circular 13/2022 related to guiding the determination of civil servant rank structure.
According to the Ministry of Home Affairs, in order to fundamentally and permanently resolve the current difficulties and problems in determining the structure of civil service ranks, the development and promulgation of this new circular will create a legal basis for agencies, organizations and units to determine the structure of civil service ranks in accordance with the organization, functions and tasks of their agencies.
At the same time, create general consistency in the structure of civil servant ranks in agencies, organizations and units with similar functions and tasks.
The draft circular has added regulations on the structure of civil servant ranks of units using civil servants under ministries and ministerial-level agencies.
Accordingly, for department-level organizations and equivalent units under ministries, the maximum number of senior experts and equivalent units is not more than 30%.
The maximum number of senior specialist and equivalent positions is not more than 50%. The remaining number of specialist, officer, employee and equivalent positions are the remaining positions.
For general department level organizations and equivalent organizations under ministries, the maximum number of senior experts and equivalent organizations under general departments is not more than 30%.

For professional agencies and administrative agencies and organizations under the Provincial People's Committee, the maximum number of senior specialists and equivalents is not more than 40%. The number of specialists, officers, employees and equivalents is the remaining number of positions.

Regarding implementation, the draft clearly states that ministries, ministerial-level agencies, government agencies, organizations established by the Government and the Prime Minister that are not public service units, and provincial and municipal People's Committees shall, based on the provisions herein, determine the civil servant rank structure of each agency and administrative organization under their management authority, as a basis for transferring ranks, raising ranks, and implementing regimes and policies for civil servants.
In case the proportion of civil servant ranks according to the structure approved by competent authority is not enough, the missing number will be added to the next lower rank.
In case the actual number of available positions exceeds the prescribed ratio, the exam and promotion to the civil servant rank that exceeds the ratio will be temporarily not organized.
