Removing 'bottlenecks', unblocking land resources

The Land Law was passed by the National Assembly and came into effect 5 months earlier than expected, helping to free up land resources and remove many industry bottlenecks that have long stagnated the economy.

2025 is predicted by many experts to be a breakthrough year for the land management sector when in 2024, the Land Law was passed by the National Assembly and took effect from August 1, 2024 (5 months earlier than expected on January 1, 2025), helping to unblock land resources and remove many bottlenecks in the sector that have long stagnated the economy.

Speeding up the effective time of the law so that it can soon come into effect has contributed to continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use in the coming time.

Adjusting land price list in localities

According to Ms. Doan Thi Thanh My, Director of the Department of Land (Ministry of Natural Resources and Environment), after 5 months of implementing the 2024 Land Law, initial results show that the new policies have brought about effectiveness, especially in the implementation of land users' rights, land recovery, compensation, support, resettlement, land price determination, and certification, etc. Thereby, creating consensus among the majority of people, the business community and unity among agencies from the central to local levels, contributing to the liberation of land resources for the country's socio-economic development.

Up to now, land units have consulted and submitted to the Ministry's leaders to submit to the Prime Minister to issue 5/9 decrees, and issue under their authority 4/6 circulars assigned in the 2024 Land Law. Along with that, 59/63 provinces and cities nationwide have basically completed the issuance of documents detailing the Land Law.

Regarding the land price list, the Ministry of Natural Resources and Environment met with 21 provinces and cities and agreed that the land price list will be developed annually. The land price list will be first announced and applied from January 1, 2026 and adjusted from January 1 of the following year.

Ms. Doan Thi Thanh My said that this helps the land price list approach the market land price, but also increases the work pressure for localities.

In Ho Chi Minh City, the recent adjustment of land prices has affected the demand for land use purpose change of some local residents. People are worried that they will have to pay more land use fees or that the land in the planning suspension cannot be divided into plots or change the land use purpose for a long time.

When applying the adjusted land price list, they may continue to suffer losses when paying land use fees which are much higher than before when the suspended planning is removed. Decision 79 of the 2024 Land Law stipulates the adjusted land price list in Ho Chi Minh City, the application of the new land price list will start from October 31 and last until the end of 2025.

In Hanoi, the City People's Committee issued Decision No. 71/2024/QD-UBND on supplementing and amending regulations related to the principles of determining land location, land price according to land plot depth and decreasing price according to distance. This is an important document in regulating and adjusting the price list of land types in the city.

According to the new decision, the current land price list will be adjusted and continue to be effective until December 31, 2025. This is also an important stepping stone for the city to prepare for the construction of a new land price list in the period of 2026 - 2030, in accordance with the revised Land Law taking effect from 2024.

Completing national land databases

Mr. Dao Trung Chinh, Director of the Department of Land Resources Planning and Development (Ministry of Natural Resources and Environment) said that in order to effectively implement the Land Law, in 2025, relevant ministries and branches need to continue to coordinate with the Ministry of Natural Resources and Environment to complete important tasks in the land sector in 2025 such as: adjusting national land use planning to 2030 and making a national 5-year land use plan for 2026 - 2030; building and completing national land databases connected and interconnected with databases of ministries, branches and localities; building and putting into operation a centralized, unified, multi-purpose land information system...

For provinces and centrally-run cities, Mr. Dao Trung Chinh suggested continuing to strictly implement the telegrams and instructions of the Prime Minister, focusing on directing the full promulgation of assigned contents detailed in the Land Law and decrees detailing the implementation of the law to ensure a synchronous legal system, avoiding problems due to slow promulgation of detailed regulations, and not creating legal gaps.

Along with that, promote training, propaganda, and dissemination widely, regularly, and continuously to all levels, sectors, people, and businesses to create consensus and unity in awareness and implementation.

Localities need to strictly control the process and time limit for handling administrative procedures on land to ensure clear identification of people, responsibilities, tasks, and processing times; pay attention to preparing conditions for effective implementation of the Land Law in localities... strengthen inspection, examination, and handling of violations by state management agencies and land users.
