On August 13, the Prime Minister issued Decision No. 827/QD-TT establishing the National Medical Council.
The National Medical Council is an organization with the function of independently assessing the capacity to practice medical examination and treatment. The National Medical Council has its own seal, account and headquarters located in Hanoi.
The National Medical Council performs the tasks prescribed in Clause 3, Article 24; Clause 2, Article 25; Clause 3, Article 120 of the Law on Medical Examination and Treatment and Clauses 2, 3, and 4, Article 9 of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government detailing a number of articles of the Law on Medical Examination and Treatment; other tasks assigned by the Prime Minister.
The National Medical Council consists of a Chairman, no more than 3 Vice Chairmen and Council Members, of which: The Chairman of the Council is a part-time leader of the Ministry of Health. The Vice Chairmen of the Council include: One full-time Vice Chairman, one Vice Chairman who is the Director of the Department of Medical Examination and Treatment under the Ministry of Health, and one Vice Chairman who is the Director of the Department of Science, Technology and Training under the Ministry of Health.
The Prime Minister appoints and dismisses the Chairman and Vice Chairman of the National Medical Council upon the proposal of the Minister of Health. The term of office of the full-time Vice Chairman is 5 years and can be reappointed, but not more than 2 consecutive terms.
Council members include: Representatives of medical examination and treatment facilities; representatives of health sector training facilities; representatives of professional associations and health sector experts; representatives of state management agencies; including one member who is also the Council Secretary. The number of Council members is decided by the Chairman of the National Medical Council based on the actual needs of the Council.
Members of the National Medical Council are appointed and dismissed by the Chairman of the National Medical Council and work part-time. The criteria, conditions and procedures for appointment and dismissal of members of the National Medical Council are stipulated in the Regulations on Organization and Operation of the National Medical Council issued by the Prime Minister.
The National Medical Council has specialized committees to carry out the Council's tasks. Members of the specialized committees include a number of Council members and experts from hospitals, health-care higher education institutions and professional associations in the health sector.
The National Medical Council has a supporting agency, the Office of the National Medical Council. The Office of the National Medical Council is a public service unit under the Ministry of Health established by the Minister of Health in accordance with the provisions of law.
The operating expenses of the Office of the National Medical Council include the expenses for the activities of the Council and the Office of the Council from the state budget according to regulations and are arranged in the annual state budget expenditure estimates of the Ministry of Health. The Office of the National Medical Council implements the financial autonomy mechanism of a public service unit.
This Decision takes effect from August 13, 2024.
