Prime Minister: Resolve problems and provide enough medicine for medical examination and treatment

The Prime Minister assigned the Ministry of Health to preside over and coordinate with the Ministry of Justice, the Government Office, and relevant agencies to complete the dossier proposing the drafting of the Law, submit it to the National Assembly, and ensure drug supply for the people.

On September 22, at the Government Headquarters, under the chairmanship of Prime Minister Pham Minh Chinh, the Government held a thematic meeting on law making in September 2022.

Attending the meeting were Deputy Prime Ministers: Le Minh Khai, Vu Duc Dam, Le Van Thanh; Ministers, Heads of ministerial-level agencies, and Government agencies.

At the meeting, the Government listened to the draft, submission and gave opinions on the National Master Plan for the 2021-2030 period; proposed to develop the Notary Law, the amended Mineral Law, the Law amending and supplementing a number of articles of the Pharmacy Law; proposed to extend the implementation of Resolution No. 30/2021/QH15 of the National Assembly on COVID-19 prevention and control.

First time building a national master plan

Regarding the National Master Plan for the 2021-2030 period, the Government members basically agreed on the assessment: the development and submission of the Planning dossier is in accordance with legal regulations; agreed with the main content of the draft Planning. The delegates proposed and recommended a number of specific contents in the Planning to ensure comprehensiveness, integrity, connectivity and sustainability.

Regarding this content, Prime Minister Pham Minh Chinh said that this is the first time a national master plan has been developed. The plan has closely followed and ensured consistency with relevant regulations; the major orientations of the plan have closely followed and clearly demonstrated the viewpoints, development goals, and spatial allocation orientations for socio-economic activities of the country in the 2021-2030 period, with a vision to 2050, in accordance with the Resolution of the 13th National Party Congress, the 10-year socio-economic development strategy for the 2021-2030 period, and the Resolutions of the Politburo and the National Assembly on socio-economic development, sectoral and field development strategies approved by competent authorities.

The Prime Minister said that basically, the content of the Planning report has considered the rationality and logic between the components; issues of national, international and inter-regional importance have been integrated and handled, ensuring consistency and synchronization. The content of the strategic environmental assessment report basically meets the requirements prescribed by the Laws.

The Prime Minister assigned the Ministry of Planning and Investment to preside over and coordinate with the Government Office to urgently complete the draft Resolution of the Government on the National Master Plan for the 2021-2030 period, with a vision to 2050, and submit it to the Government for promulgation. The Ministry of Planning and Investment shall promptly receive, explain and complete the dossier of the National Master Plan for the 2021-2030 period, with a vision to 2050, according to the comments of Government members and in accordance with the provisions of law.

The Prime Minister authorized the Minister of Planning and Investment, on behalf of the Government, to submit to the National Assembly for consideration and decision the National Master Plan for the 2021-2030 period, with a vision to 2050, in accordance with the provisions of law.

The Prime Minister noted decentralization, delegation of authority and allocation of resources in planning management; presenting the Planning in a way that is easy to understand, easy to do, easy to check, easy to evaluate; and promptly submitting it to competent authorities.

Expanding the scope of notarization

Regarding the proposal to develop a Law on Notarization, Government members agreed on the necessity of developing and promulgating the Law, aiming to continue institutionalizing the Party and State's guidelines and policies, simplifying procedures, creating favorable conditions for transactions in society, promoting the responsibility and contribution of notaries and notary organizations to the State and society.

The content of the Notary Law ensures compliance with the Party's guidelines and policies on socialization, decentralization, delegation of power, reduction of procedures, facilitation for society, priority given to areas with difficult socio-economic conditions; effective use of state management tools to ensure correct orientation and regulation.

At the same time, it is recommended that the Ministry continue to carefully evaluate the provisions of related specialized laws to avoid overlap and lack of consistency, and propose appropriate amendments and supplements.

Prime Minister Pham Minh Chinh agreed to expand the scope of notarization in a way that facilitates businesses and people but ensures reducing the burden on state agencies and increasing the responsibility of notaries and notary organizations towards the people as well as towards the State.

In particular, the content of digital transformation needs to be processed synchronously according to legal regulations on electronic transactions. The Notary Law only stipulates principles and truly specific and separate contents (if any). Building a database is necessary, but it is necessary to propose building a master plan with other databases of the Judicial sector and being able to connect and share national data.

Regarding the proposal to add notary responsibilities for real estate transactions, it is necessary to ensure that it helps improve the efficiency of State management, facilitates people and businesses, reduces procedures and costs. In particular, fees and charges need to be calculated appropriately so that people can access them and create reasonable revenue for the budget.

Economical and sustainable exploitation of resources

Regarding the proposal to develop the Law on Minerals (amended), delegates agreed on the necessity of developing and promulgating the Law, aiming to institutionalize Resolution 10-NQ/TW of the Politburo on strategic orientation of geology, minerals and mining industry to 2030, with a vision to 2045; to address existing problems, limitations and obstacles; to enhance the effectiveness and efficiency of state management of geology and minerals; to contribute to promoting rapid and sustainable socio-economic development and environmental protection.

The Prime Minister proposed that the development of the Law on Minerals (amended) must aim to strengthen State management, but also liberate resources; economically and sustainably exploit resources; and protect the environment.

The law must resolve obstacles; regulate practical issues that have not yet been regulated; strengthen decentralization, along with resource allocation, inspection, supervision, creating a healthy and smooth implementation environment.

Along with giving specific opinions on each content of the Law on Minerals (amended), the Prime Minister assigned the Ministry of Natural Resources and Environment to preside over and coordinate with the Ministry of Justice, the Government Office, and relevant agencies to continue reviewing and evaluating policies, supplementing and perfecting solutions, ensuring comprehensiveness, clarity, consistency, and feasibility; editing and perfecting the dossier proposing the drafting of the Law, and sending it to the Ministry of Justice to propose adding this Law project to the National Assembly's Law and Ordinance Drafting Program in 2023.

Timely resolve problems, provide adequate medicine for medical examination and treatment

Regarding the proposal to develop a Law amending and supplementing a number of articles of the Law on Pharmacy, Government members said that amending the Law on Pharmacy is necessary to institutionalize Resolution No. 20/NQ-TW dated October 25, 2017 of the 12th Party Central Committee on strengthening the protection, care and improvement of people's health in the new situation; ensuring adequate supply of drugs in terms of quantity, good quality, reasonable prices, meeting the needs of disease prevention and treatment, encouraging businesses to invest in the production of drugs, vaccines, biological products, medical equipment and supplies, and participating more deeply in the pharmaceutical value chain in the region and the world.

The Prime Minister suggested that the Law should ensure consistency and synchronization in the current legal system on pharmaceutical management, production and trading; maximum access to international practices as well as conformity with international treaties to which Vietnam is a member; remove obstacles; minimize administrative procedures. Regulations that need to be amended and supplemented must be clearly defined in terms of content, amendment and supplement plans and specific impact assessments.

In particular, promptly resolve difficulties and problems arising from the practice of pandemic prevention and control and urgent issues that need to be resolved immediately to ensure adequate supply of medicines for medical examination and treatment for the people, in accordance with the socio-economic development situation; ensure scientific, safe, timely and effective.

The Prime Minister gave his opinions on the contents of ensuring adequate and timely supply of drugs to meet the requirements of security, national defense, overcoming the consequences of natural disasters, and preventing and fighting epidemics in the new situation; further enhancing the adequate and timely supply of quality drugs to meet the people's disease prevention and treatment needs; improving the effectiveness of management of the export and import of drugs and pharmaceutical ingredients in accordance with the socio-economic development situation and international practices.

The Prime Minister assigned the Ministry of Health to preside over and coordinate with the Ministry of Justice, the Government Office, and relevant agencies to continue reviewing and evaluating policies, seeking opinions from agencies, experts, scientists, and influential entities to supplement and perfect solutions, ensuring comprehensiveness, clarity, consistency, and feasibility; to revise and perfect the dossier proposing the drafting of the Law, submit it to the National Assembly, and ensure the supply of medicine for the people.

Proposal to extend the implementation of Resolution 30 of the National Assembly on epidemic prevention and control

Regarding the summary of the implementation of Resolution No. 30/2021/QH15 dated July 28, 2021 of the first session of the 15th National Assembly, the Prime Minister said that this Resolution has created a legal basis, increased the initiative of the Government, the Prime Minister and localities in the work of preventing and fighting the COVID-19 epidemic; contributing to the effective prevention and control of the COVID-19 epidemic. In addition, during the implementation process, the situation has had new developments.

Therefore, it is necessary to summarize, review, and accurately evaluate the results and effectiveness of the Resolution; propose to continue to extend the implementation of policies, especially to supplement and adjust policies promptly to meet the requirements and demands of practical life; in the spirit of putting people's health and lives first and foremost.

The Prime Minister emphasized that based on the results of the summary of Resolution No. 30/2021/QH15 discussed by the Government, the Ministry of Health was assigned to preside over and coordinate with relevant agencies to complete the draft to submit to the National Assembly for permission to continue implementing solutions, policy mechanisms and resolving difficulties and problems arising from epidemic prevention practices.

At the end of the meeting, Prime Minister Pham Minh Chinh commended the Government members for promoting their sense of responsibility, time, and effort, focusing on law-making and providing accurate and practical comments on urgent issues of the country.

The Prime Minister emphasized that institutional building and improvement is one of the three strategic breakthroughs identified by the 13th National Party Congress. Therefore, in the coming time, members of the Government, ministries, branches and localities will continue to devote time, effort and intelligence to urging the work of institutional building and improvement; closely coordinate with the National Assembly agencies to continue to concretize the Party's policies and guidelines into life.
