The leader of the National Institute for Food Safety and Hygiene Control (Ministry of Health) said that there are test results of Kera vegetable candy advertised by Miss Thuy Tien, Quang Linh Vlogs, and Hang Du Muc.
On the morning of March 20, the leader of the National Institute for Food Safety and Hygiene Control (Ministry of Health) said that the unit had the test results of Kera vegetable candy.
Previously, the institute received and tested Kera vegetable candy samples sent from authorities in Dak Lak and Ho Chi Minh City. The test results have been returned to the locality where the samples were sent and sent to the Department of Food Safety (Ministry of Health) for reporting.
The source said that the manufacturer's announcement about the content of ingredients in Kera vegetable candy is basically consistent with the test results. Specifically, the indicators of sugar, protein, fat, and energy are basically consistent with the announced information. However, those who promoted the product "overstated" the advertisement when they said "one candy is equivalent to a plate of vegetables".
According to regulations, health protection foods and foods for special diets - two types of functional foods, advertising content must be registered with the competent authority. Specifically, before being advertised, health protection food products must register for advertising confirmation with the Food Safety Department and can only be advertised according to the confirmed content.
As for food supplements, management is decentralized to the locality, the production unit self-declares, is responsible for the content and ensures compliance with regulations under the Law on Advertising and the Law on Food Safety.
On the evening of March 14, the Department of Radio, Television and Electronic Information (Ministry of Culture, Sports and Tourism) said that this unit had invited 3 people including Nguyen Thi Thai Hang (Hang Du Muc), Pham Quang Linh (Quang Linh Vlogs), Nguyen Thuc Thuy Tien (Miss Thuy Tien) to work to clarify the level of participation in livestream sessions selling Kera vegetable candy products.
This was announced after the Department received a dispatch from the Department of Food Safety, Ministry of Health, requesting to check and handle information related to the livestream sales session of this group of people.
According to the conclusion of the Department, in these livestreams, Hang and Linh were identified as the hosts, Thuy Tien was the guest. At the meeting, all three admitted and accepted their mistakes for providing false product information.
The Department of Radio, Television and Electronic Information said that it had drawn up a record of administrative sanctions against Pham Quang Linh and Nguyen Thi Thai Hang for their false advertising, causing confusion about the quality of the products that had been announced. Nguyen Thuc Thuy Tien was reminded to pay more attention to complying with legal regulations on advertising and regulations on providing information online, according to Decree 147.
The Department of Radio, Television and Electronic Information has not yet given a specific fine, but said a decision on the penalty will be made this week.
According to Clause 5, Article 34 of Decree 38, on administrative sanctions in the field of culture and advertising, acts of advertising that are incorrect or misleading will be fined from 60 million VND to 80 million VND.
At the press conference on the afternoon of March 14, Quang Linh Vlogs and Hang Du Muc both apologized to users. "I apologize to customers for my negligence at work, conveying incorrect product information terminology. Kera candy mainly supplements nutrition from green vegetables, the main ingredient is from vegetables," Quang Linh said, but did not mention the fiber content.
He also affirmed that "the product cannot replace vegetables but only supplements nutrition".
Hang Du Muc added, "This is a supplement, not a functional food. The ingredients were checked before being put on the market."
She admitted that "she is young and inexperienced", so in the process of sharing, her statements were "a bit excessive" and caused people to misunderstand.
When asked about the possibility of being punished for false advertising, both said they would cooperate with authorities and if wrong, they were ready to comply with the law.
The noise of "exaggerated" advertising of Kera vegetable candy has been going on for nearly a month. This is a product introduced by Asia Life Joint Stock Company (Dak Lak) produced by order of Chi Em Rot Group Joint Stock Company (CER Group) headquartered in Ho Chi Minh City, founded by Hang Du Muc, Quang Linh Vlogs and some founding members.
