Hai Duong tried 2 subjects of "case-fixing" fraud

On the morning of June 20, Hai Duong Provincial People's Court opened a first-instance trial for two defendants on charges of fraud and property appropriation.

According to the indictment, from January 20 to 21, 2022, Pham Van Kien (born in 1988, residing in An Luu ward, Kinh Mon) and Le Hoang Linh (born in 1977, residing in Phu Ninh commune, Thuy Nguyen, Hai Phong city) provided false information about Mr. Bui Xuan Thuan (born in 1984, residing in Phu Thu ward, Kinh Mon). That is, Linh and Kien could influence the competent authority conducting the proceedings of An Duong district (Hai Phong city) to arrange for Ms. Nguyen Thi Tu (Mr. Thuan's wife) to change the preventive measure from temporary detention to bail.

Trusting Kien and Linh, Mr. Thuan transferred a total of 3 billion VND to Kien many times, Kien transferred 2 billion VND to Linh, and kept 1 billion VND. After receiving the money, Kien and Linh used it to pay off debts, buy an apartment in Ha Long City (Quang Ninh) and for personal expenses.

By February 15, 2022, Ms. Tu was not allowed to change the preventive measures as Linh had promised, so Mr. Thuan filed a complaint with Kinh Mon Town Police.

In this case, Kien was the one who directly agreed to receive 3 billion VND from Mr. Thuan, so he must bear criminal responsibility for the 3 billion VND he appropriated and played the first role in the case. Linh, Kien's accomplice, must bear criminal responsibility for the 2 billion VND he appropriated.

Linh was once sentenced to 24 months in prison with a suspended sentence by the People's Court of Thuy Nguyen district for illegally trading invoices.

The jury sentenced Pham Van Kien and Le Hoang Linh to 14 years in prison for fraud and property appropriation.
