This Resolution regulates the use of experts by the Chairman of the National Assembly, Vice Chairman of the National Assembly, Secretary General of the National Assembly, the Council of Nationalities, Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, and the Office of the National Assembly (hereinafter referred to as “competent agencies and persons”).
Experts include former National Assembly deputies, scientists, managers, researchers, and practical workers at home and abroad; meeting the conditions and standards specified in Article 3 of this Resolution.
The use of experts must be based on the requirements and tasks of each agency and competent person and must ensure publicity, transparency, and compliance with prescribed standards and conditions; agencies and competent persons, depending on the nature of the work, may use experts to work regularly or for specific work content at a certain time, ensuring practicality and efficiency; based on the actual situation, work needs and specific fields, agencies and competent persons shall decide on the number of experts to be used.
According to the resolution, experts must have a university degree or higher, have expertise appropriate to the field requiring consultation; have a clear background, good political and moral qualities, good health, enthusiasm, capacity, practical experience, extensive knowledge, intelligence and prestige in consulting, policy and strategy planning. Have the ability to consult proficiently in a number of specific fields that have been confirmed in practice; be ready to receive and complete assigned tasks.
Experts have the following duties and powers: to research, provide information, complete reports, articles, speeches, comments, remarks, statements, and suggestions according to assigned tasks and fields; to advise competent agencies and individuals in law-making activities; other issues related to the activities of the National Assembly and its agencies; issues of concern to competent agencies and individuals in law-making and ordinance-making activities; to supervise the activities of the state apparatus and decide on important national issues.
Experts are invited to attend meetings: the entire Committee, the expanded Standing Committee; annual thematic meetings, other meetings of the National Assembly agencies, agencies of the National Assembly Standing Committee, the National Assembly Secretariat according to the decision of the conference convening level; are provided with relevant information and documents; are allowed to attend and express their views and opinions in meetings, seminars, conferences, explanation sessions, working groups, surveys, and supervisions related to the assigned sector and field; and are paid remuneration according to regulations.
Experts are obliged to comply with regulations on information security and other obligations as prescribed by law; perform other tasks assigned by the agency or person directly using the information.
This Resolution comes into force after 45 days from February 16, 2022.
