The Government proposes a series of special mechanisms for the capital Hanoi.

Hanoi City is proposed to apply a special mechanism on remuneration for talented people and additional income for officials, civil servants and public employees, in the draft revised Capital Law.

The Government's recent submission to the National Assembly proposed that cadres in Hanoi be managed uniformly from commune to city level with common standards. To attract talented people to contribute to the city, the Government proposed that Hanoi have its own talent treatment regime, such as recruitment without examination.

Similar to the mechanism applied to Ho Chi Minh City, Hanoi is also allowed to pay additional income to cadres, civil servants, and public employees of agencies, units of the capital and some central vertical agencies located in the area. The total amount spent on this content does not exceed 0.8 times the basic salary fund of cadres, civil servants, and public employees.

In addition, Hanoi is provided with a number of incentives for science and technology that are different from current laws, including expanding the scope of application of the form of funding compared to the Law on Science and Technology. The city regulates the development orientation of high-tech zones in the capital and some general issues regarding Hoa Lac High-Tech Park and the Hanoi High-Tech Park Management Board.

The City People's Council also stipulates the content and level of support higher than current regulations for artisans and practitioners of intangible cultural heritage; teaching, practicing, and promoting the value of intangible cultural heritage.

Add city to Hanoi city

The Government proposed to implement the model of not organizing ward People's Councils in Hanoi according to Resolution No. 97 and adding cities to Hanoi. The number of city People's Council delegates therefore increased from 95 to 125, the proportion of full-time delegates from 20% to 25%. The number of Vice Chairmen of the People's Council increased from 2 to a maximum of 3; the composition of the Standing Committee of the People's Council was expanded compared to the Law on Organization of Local Government to improve the capacity and increase the professionalism of this agency.

The organizational structure of the city government of Hanoi is expected to be established according to Resolution No. 15: in the North - the city of logistics and services (Dong Anh, Me Linh, Soc Son areas) and in the West - the city of education, training and science (Hoa Lac, Xuan Mai areas).

This city has a different characteristic compared to the district, town and city governments, which is to increase the number of Vice Chairmen of the People's Council, People's Committee, full-time People's Council delegates, and to add an Urban Committee. The People's Council of the city under Hanoi city is allowed to decide to establish, reorganize, and dissolve a number of specialized agencies, administrative organizations, and special public service units; and to organize the recruitment of civil servants for agencies and organizations.

Empowering the City People's Council and People's Committee

The revised Capital Law also proposes a series of other specific mechanisms for Hanoi. For example, the City will be given additional staff to meet actual needs; the Standing Committee of the City People's Council will have additional powers such as deciding on measures to resolve urgent and extraordinary matters; deciding on adjusting investment policies for public investment projects in groups B and C, etc.

The Government proposes to decentralize the authority from the Prime Minister to the City People's Committee to locally adjust the general planning for functional area construction, general urban planning, and specialized technical infrastructure planning (similar to what is being done in Ho Chi Minh City). The City People's Committee is allowed to expand the scope of investment projects, and when making detailed planning, it must determine the land to be recovered in the surrounding area for urban reconstruction and on-site resettlement; and provide principles for underground space.

Some investment authorities from the National Assembly and the Prime Minister as stipulated in the Investment Law and the Public Investment Law are also proposed to be decentralized to the City People's Council and People's Committee. For example, the City People's Council decides on the investment policy for urban railway projects; projects using a maximum of VND20,000 billion in public investment capital; allowing Hanoi to issue its own economic-technical norms, cost norms, and unit prices, in accordance with the actual situation, characteristics, and needs of construction and development of the Capital.

The capital's public general education institutions are allowed to cooperate with foreign educational institutions. The City People's Council regulates the financial mechanism applicable to high-quality, multi-level public educational institutions. The City People's Committee regulates the addition of preschool and general education programs suitable to the economic, cultural and social conditions of the capital to increase the initiative and creativity of learners.

In addition, the City People's Council decided to allocate the budget to support poverty reduction, job creation, and loans to buy social housing; support workers and laborers in industrial parks to borrow to buy social housing; regulate support for social insurance premiums; and support free annual health check-ups for the elderly residing in the capital.

Relocate polluting facilities out of the inner city

The bill proposes that the city should regulate the relocation of industrial production facilities that cause long-term environmental pollution or are labor-intensive, and medical facilities with high risks of infection and transmission out of historical inner-city areas and central urban areas; and allow support and incentives for purchasing and converting means of transport from using fossil fuels to using clean energy.

The city retains 100% of land use fees and land leases to carry out the task of developing the Capital Region, supporting the relocation of central agencies, schools, hospitals, and production facilities according to the planning to have land funds to develop technical infrastructure and social infrastructure to serve the community.

The bill adds three areas in which Hanoi is allowed to impose fines that are higher but not more than twice the general fines set by the Government, including fire prevention and fighting, food safety and hygiene, and advertising. The city is also allowed to prescribe measures to prevent and ensure handling of administrative violations, such as stopping the supply of electricity and water services at the location of the violation for constructions, production and business establishments that violate the land, construction, housing, and fire prevention and fighting regulations.

The revised Capital Law will be discussed by the National Assembly in groups on the afternoon of November 10. On the same day, delegates will also give their opinions on three drafts: the Road Law, the Road Traffic Order and Safety Law, and the revised Archives Law.
