Trial of Mr. Tran Qui Thanh and his two daughters for appropriating more than 1,048 billion VND from others

Mr. Tran Quy Thanh and his two daughters appeared in court on charges of abusing trust to appropriate assets of four individuals totaling more than VND1,048 billion.

Today, April 23, the People's Court of Ho Chi Minh City tried the case of abuse of trust and property appropriation against Mr. Tran Qui Thanh (Director of Tan Hiep Phat Company) and his two daughters, Ms. Tran Uyen Phuong (43 years old) and Ms. Tran Ngoc Bich (40 years old).

At exactly 8:00 a.m., defendant Tran Qui Thanh and his daughter Tran Uyen Phuong were escorted to court. The third defendant who was released on bail, Tran Ngoc Bich, also appeared in the courtroom shortly after.

The trial is expected to last from today until April 25, with Judge Huynh Van Truc presiding.

Representatives of the Ho Chi Minh City People's Procuracy participating in the trial as assigned by the Supreme People's Procuracy include: Mr. Vu Tat Ba, Mr. Pham Van Hien and Mr. Mai Hoan Dong.

The victims in the case were identified as: Ms. Dang Thi Kim Oanh, Mr. Nguyen Van Chung, Mr. Lam Son Hoang, Mr. Nguyen Huy Dong.

Kim Oanh Dong Nai Investment and Development Joint Stock Company and 34 other individuals participated in the trial as persons with rights and obligations related to the case.

Mr. Tran Qui Thanh and his two daughters have four defense lawyers.

According to the indictment, from 2019 to 2020, Mr. Tran Qui Thanh, Tran Ngoc Bich, and Tran Uyen Phuong, through brokers, lent money to four individuals at an interest rate of 3% per month. The total value of the property appropriated from all four victims was determined to be more than VND 1,048 billion.

The lending condition is that the owners of the mortgaged assets or projects must sign a contract to transfer the assets or shares of the project to conceal the nature of the loan.

Just lost property, just lost court

Among the four victims, Mr. Nguyen Huy Dong lost his property and was sued by Mr. Thanh's daughter.

Accordingly, in 2017, Mr. Nguyen Huy Dong mortgaged 2 plots of land to a bank for 59 billion VND. In January 2019, Mr. Dong needed to borrow 67 billion VND to pay off the bank debt and was introduced to Mr. Tran Qui Thanh by a broker.

The broker discussed the loan terms: Mr. Dong had to pay an interest rate of 3%/month but had to transfer 2 plots of land to Ms. Tran Uyen Phuong and pay a brokerage fee of 6%/total loan amount.

When meeting Mr. Thanh, Mr. Dong offered to borrow 90 billion VND but Mr. Thanh only agreed to lend 80 billion VND.

After reaching an agreement, in early February 2019, Mr. Dong released the mortgage of the 67 billion VND loan at the bank and made a fake contract to transfer it to Ms. Uyen Phuong at Hoang Xuan Ngu notary office.

Ms. Uyen Phuong was not present at the notary office but authorized her staff to carry out the procedures to transfer the names of the two plots of land.

After completing the above procedures, Mr. Dong received a handwritten paper with the content "borrowed 80 billion, paid the bank 67.4 billion, 3-month interest is 7.2 billion, brokerage fee is 2.5 billion, personal income tax and registration tax (2.5%) is 1.684 billion VND, the remaining amount actually received is 1.241 billion VND". Only then did Mr. Dong know that he had only actually received more than 1.2 billion VND but was forced to sign a confirmation.

On February 18, 2019, Mr. Dong was called by the Binh Tan branch of the Land Registration Office to verify the change of land user name to Ms. Tran Uyen Phuong. Mr. Dong tried to contact Phuong many times but could not get through. Therefore, Mr. Dong requested to stop changing the ownership name of the 2 land plots.

After that, Mr. Dong went to Tan Hiep Phat Company to meet Mr. Tran Qui Thanh to ask to pay 80 billion VND to redeem the 2 plots of land, but Tan Hiep Phat asked him to pay 95 billion VND. Mr. Dong texted to ask for a reduction, but Mr. Thanh did not respond.

After that, Ms. Tran Uyen Phuong sued Mr. Dong, disputing the two plots of land above and the People's Court of District 3 accepted all of Ms. Phuong's requests, forcing Mr. Dong to continue to fulfill his obligations in the sales contract.

On June 8, 2023, the Ministry of Public Security's Investigation Police Agency sent a document to the High People's Procuracy in Ho Chi Minh City requesting a review to annul the first instance judgment.

In early 2024, the High People's Court in Ho Chi Minh City held a retrial and annulled the above first instance judgment of the District 3 People's Court.

The value of the embezzlement in this case was determined to be 38.9 billion VND.
