The Law amending and supplementing a number of articles of the Law on Organization of the National Assembly stipulates that the Standing Committee of the National Assembly will consider and decide to temporarily suspend the performance of duties and powers of National Assembly deputies in specific cases.
On the afternoon of February 17, with 461/461 delegates present in favor, the National Assembly passed the Law amending and supplementing a number of articles of the Law on Organization of the National Assembly.
Rename extraordinary session to extraordinary session
Previously, some National Assembly deputies proposed to change the phrase "the National Assembly holds an extraordinary session" to "the National Assembly holds an irregular session" or "the National Assembly has a thematic session".
On behalf of the National Assembly Standing Committee, presenting the report on explanation and acceptance, Chairman of the Law Committee Hoang Thanh Tung said that the Committee accepted these opinions.
The National Assembly holds regular sessions twice a year. The law states that extraordinary sessions of the National Assembly are held at the request of the President, the National Assembly Standing Committee, the Prime Minister or at least one-third of the total number of National Assembly deputies to promptly consider and decide on urgent issues under the authority of the National Assembly to meet the requirements of socio-economic development, national defense, security and foreign affairs.
At the same time, the National Assembly Standing Committee continues to study the numbering of regular and irregular sessions of the National Assembly appropriately for unified implementation from the next term.
Regulations on temporary suspension of duties of National Assembly deputies
Article 39 of the new law stipulates the temporary suspension or loss of the rights of National Assembly deputies. In particular, the National Assembly Standing Committee shall consider and decide to temporarily suspend the performance of duties and powers of National Assembly deputies in the following cases: National Assembly deputies are prosecuted; In the process of considering and handling violations of National Assembly deputies, there is a basis to determine that disciplinary action from warning or higher must be taken against National Assembly deputies who are cadres, civil servants, public employees or handled by criminal law...
The Law also stipulates that a National Assembly deputy may return to performing his/her duties and powers as a deputy and have his/her legitimate interests restored when a competent authority has a decision or conclusion that there has been no violation, no disciplinary action, a decision to suspend the investigation or suspend the case against that deputy, or from the date the court's verdict or decision takes legal effect declaring that the deputy is innocent or exempted from criminal liability.
In case a National Assembly deputy is disciplined, depending on the nature and extent, he/she may request to resign from performing the duties of a deputy or the National Assembly Standing Committee shall consider and decide whether to allow him/her to return to performing the duties and powers of a deputy or propose that the National Assembly dismiss the National Assembly deputy.
A National Assembly deputy convicted by a court verdict or decision shall automatically lose his/her National Assembly deputy rights from the date the court verdict or decision takes legal effect.
