Principles for evaluating and classifying the quality of cadres, civil servants and public employees

Quality assessment and classification must be based on assigned responsibilities and tasks and task performance results, demonstrated through specific work and products.

On August 3, 2023, the Ministry of Home Affairs issued Document No. 3/VBHN-BNV merge Decree No.90/2020/ND-CPdated August 13, 2020 of the Government on assessment and classification of the quality of cadres, civil servants and public employees and Decree No.48/2023/ND-CPJuly 17, 2023 amending and supplementing a number of articles of Decree No.90/2020/ND-CP.

Article 2 of Document No. 3/VBHN-BNV defines the principles for evaluating and classifying the quality of cadres, civil servants and public employees. Specifically:

1. Ensure objectivity, fairness, and accuracy; no favoritism, suppression, bias, or formality; ensure proper authority in managing and evaluating cadres, civil servants, and public employees.

2. The assessment and classification of quality must be based on the assigned responsibilities and tasks and the results of the task implementation, demonstrated through specific work and products; for cadres, civil servants, and leaders and managers, it must be linked to the results of the task implementation of the agency, organization, or unit assigned to manage and be in charge.

3. Cadres, civil servants and public employees whose working time in the year is less than 6 months will not be assessed or classified for quality but must still review their working time in the year, except in cases of maternity leave.

Officials, civil servants and public employees who take leave from work according to the law for 3 to less than 6 months during the year will still be evaluated but will not be classified as having completed their tasks well or better.

For cadres, civil servants and public employees who take maternity leave according to the provisions of law, the quality classification result in the year is the quality classification result of the actual working time of that year.

4. The results of the assessment and classification of the quality of cadres, civil servants and public employees according to the provisions of this Decree shall be used as the basis for interconnection in the assessment and classification of the quality of Party members.

5. Cadres, civil servants and public employees subject to party or administrative discipline shall have their quality assessed and classified as follows:

a) Cadres, civil servants and public employees who are subject to party or administrative disciplinary action in the year of assessment shall be classified as having failed to complete their tasks, except for the case specified in Point b of this Clause.

b) In case the violation has not yet been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.

c) In case a cadre, civil servant or public employee is a party member and has been subject to party discipline and administrative discipline for the same violation but the party discipline decision and administrative discipline decision do not take effect in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment...

6. The rate of cadres, civil servants and public employees classified as "Excellently completing tasks" out of the total number of cadres, civil servants and public employees at the same agency, organization or unit and for each group of subjects with similar tasks must not exceed the rate of Party members classified as "Excellently completing tasks" according to Party regulations. In cases where agencies, organizations or units have outstanding achievements, exceed the assigned tasks plan, complete unexpected tasks well, propose or organize innovation and creativity to create positive changes, bring practical value and efficiency, the competent authority shall decide on the rate of excellently completing tasks in accordance with reality, ensuring the rights and legitimate interests of cadres, civil servants and public employees.
