Car drivers could be fined between VND16 and 18 million and have their driving license deducted by six points if they drive in the wrong direction or reverse on the highway, according to a proposal by the Ministry of Public Security.
In order to guide the Law on Road Traffic Safety and Order, the Ministry of Public Security is seeking opinions on a draft Decree on administrative penalties for violations of road traffic safety and order. Compared to current regulations, the fine for reversing on the highway remains the same, but the driver's license will not be revoked for 5-7 months but will be deducted 6 points.
According to the draft, a fine of VND10-12 million will be imposed on drivers who stop or park on the highway in an incorrect location; do not signal with emergency lights when encountering a technical problem or other force majeure that requires stopping or parking in the emergency lane in the same direction as the vehicle is traveling on the highway; do not signal with emergency lights and place a sign or warning light at least 150 meters behind the vehicle when encountering a problem that requires stopping or parking on part of the lane; or make a U-turn on the highway. In addition to the fine, the driver will also have 3 points deducted from his/her driver's license.
Compared to current regulations, for the above group of behaviors, the penalty remains the same but the driver's license is revoked for 2-4 months.
Vehicles driving in the emergency lane will be fined 4-6 million VND.
The Ministry of Public Security has proposed a fine of VND4-6 million for drivers who drive in the emergency lane or on the side of the highway; change lanes in the wrong place or without signaling before driving on the highway; or do not comply with regulations on safe distance from the vehicle in front when driving on the highway. If the driver causes an accident, 3 points will be deducted from the driver's license.
The above fines also apply to the acts of going in the wrong direction on a one-way street, going in the wrong direction on a street with a "No Entry" sign; overtaking when overtaking is not allowed, overtaking at a section with a sign prohibiting overtaking; not signaling before overtaking, or not using the overtaking signal during the overtaking process; overtaking on the right side of another vehicle when not allowed.
According to current regulations, drivers driving in the emergency lane on the highway will be fined 3-5 million VND and may have their driver's license revoked for 1-3 months.
Not giving way to the vehicle behind will be fined 2-3 million VND
The Ministry of Public Security has proposed a fine of VND2-3 million for not giving way to vehicles that want to overtake when it is safe to do so. If an accident occurs, the driver's license will be deducted by 3 points. According to current regulations, this behavior is subject to a fine of VND2-3 million and a driver's license suspension for 1 to 3 months.
Drivers who drive at a slower speed than other vehicles traveling in the same direction and do not move to the right lane of their lane can also be fined VND400,000-600,000. If they cause an accident, the driver will lose 3 points on their driving license.
According to current regulations, this violation is subject to a fine of the same amount, but can result in the driver's license being revoked for 2 to 4 months if causing a traffic accident.
For drivers who change lanes in an unauthorized place, or without signaling, or change lanes in violation of the regulation that "each lane change is only allowed to be made to an adjacent lane", the proposed fine is 400,000-600,000 VND. Current regulations have equivalent fines.
Currently on many highways and national highways, there is a situation where drivers want to occupy the left lane close to the median strip even when driving slowly, causing conflicts with fast-moving vehicles asking to overtake, increasing the risk of traffic jams and accidents.
The Law on Road Traffic Safety and Order, recently passed by the National Assembly, inherits most of the regulations on vehicles traveling on highways, overtaking, changing lanes, giving way... of the current Law on Road Traffic and provides more details in some situations to resolve the above situation.
The Law on Road Traffic Safety will take effect from January 1, 2025.
