According to the Government's Submission, the draft Law consists of 13 chapters with 196 articles. Compared to the 2014 Housing Law, the draft Law (amended) has increased by more than 13 articles; of which 7 articles in the current Law are abolished; 47 articles are kept unchanged; 104 articles are amended and supplemented; 34 new articles are added; and 11 articles are legalized from Decree.
The development of the Housing Law (amended) aims to promptly institutionalize the Party's guidelines and policies and the State's policies in developing housing for the people, especially low-income people and the poor, who are unable to create housing according to the market mechanism.
At the same time, amend and perfect the provisions of the 2014 Housing Law to suit the actual situation, remove existing problems and limitations, ensure constitutionality, consistency and synchronization with other relevant laws.
In addition to amending and supplementing a number of provisions of the 2014 Housing Law, the draft Law has legalized a number of provisions from Decree No. 69/2021/ND-CP to ensure high legal validity and consistency of the legal system such as cases of demolition of apartment buildings; principles of renovation and reconstruction of apartment buildings; inspection and assessment of the quality of apartment buildings; forms of renovation and reconstruction of apartment buildings; selection of investors for projects to renovate and rebuild apartment buildings...
Incorporating the opinions of the National Assembly Standing Committee at the March 2023 session, the draft Law submitted to the National Assembly has removed the option on the term of ownership of apartment buildings.
However, the draft Law supplements regulations on the term of use of apartment buildings, cases of demolition, and clarifies the responsibilities of related entities when demolishing, renovating, and rebuilding apartment buildings.
This, according to the Government, is to have a legal basis to resolve practical difficulties and problems.
In the working session on the afternoon of June 19, the National Assembly will vote to pass the Resolution on approving the 2021 State budget settlement and vote to pass the Law on Prices (amended).
