Proposing the Chairman of the Provincial People's Committee to appoint the Chairman of the Commune People's Committee after the merger

The Ministry of Home Affairs proposed that the Chairman of the Provincial People's Committee appoint the Chairman, Vice Chairman and members of the Commune People's Committee after the merger until the new term People's Committee is elected.

The above content is mentioned in the draft Resolution of the National Assembly Standing Committee on administrative unit arrangement, drafted by the Ministry of Home Affairs.

The Draft Resolution devotes Article 12 to regulating the arrangement and consolidation of the organizational apparatus of agencies and organizations after the arrangement of administrative units.

Accordingly, the arrangement and consolidation of local government agencies and organizations when arranging administrative units must ensure the principle of unity and be associated with the arrangement of Party organizations and socio-political organizations at the same level according to the guidance of competent authorities.

Regarding the organization of local government after the arrangement of administrative units at the same level, the drafting agency proposes that the Standing Committee of the Provincial People's Council appoint the Chairman of the People's Council of the commune or ward after the arrangement.

"The Chairman of the Provincial People's Committee shall appoint the Chairman, Vice Chairman and members of the Commune and Ward People's Committees and arrange them to perform the tasks and powers of the Chairman of the People's Committee and the People's Committee according to the provisions of the Law on Organization of Local Government until the new People's Committee is elected," the draft Resolution stated.

According to the draft, People's Council delegates of old administrative units will be merged into the People's Council of the new administrative unit and continue to operate until the end of their term.

New wards in urban areas that do not have People's Councils will continue to not have them. The organization of People's Councils for the 2026-2031 term will be implemented in accordance with the provisions of the Law on Organization of Local Government.

Regarding the term of the People's Council in the new administrative unit after the rearrangement, the draft stipulates that in case the new administrative unit after the rearrangement retains the name of one of the administrative units before the rearrangement, the term of the People's Council in the administrative unit after the rearrangement will continue to be calculated according to the term of the People's Council in the administrative unit that retains the same name.

In case the new administrative unit after the rearrangement has a different name from the previous administrative units, the term of the People's Council in the new administrative unit after the rearrangement will be recalculated from the beginning (term I) from the time of establishment.

The Draft Resolution also mentions the organization of agencies under the People's Council, specialized agencies and other administrative organizations under the Provincial People's Committee in the administrative unit after the arrangement.

Specifically, the existing committees of the provincial People's Council have the same functions and tasks.

In case of merging a provincial-level administrative unit with an Ethnic Committee under the Provincial People's Council with a provincial-level administrative unit without an Ethnic Committee under the Provincial People's Council, when forming the new provincial-level administrative unit, the Ethnic Committee under the Provincial People's Council will still be organized until the end of its term.

The organization of the Ethnic Committee under the Provincial People's Council for the next term shall comply with the regulations of the National Assembly Standing Committee on standards and conditions for establishing the Ethnic Committee under the Provincial People's Council.

The drafting agency also proposed to merge the status quo of other specialized agencies and administrative organizations under the provincial People's Committee with the same functions and tasks; for specialized agencies and other administrative organizations with different functions and tasks, the establishment, reorganization and dissolution shall comply with Government regulations.

According to the draft Resolution, the organization of agencies of the People's Council, People's Committee of communes and wards, and public service units providing public service in the administrative unit after the arrangement is implemented according to the instructions of the competent authority.

From the effective date of the National Assembly's Resolution on the arrangement of provincial-level administrative units, agencies and organizations in the new provincial-level administrative units after the arrangement must complete the arrangement and consolidation of the organizational apparatus.

From the effective date of the Resolution of the National Assembly Standing Committee on the reorganization of commune levels, agencies and organizations in the newly reorganized communes and wards must complete the reorganization and consolidation of their organizational apparatus.
