Hai Duong considers regulating the budget for drafting legal documents

At the 16th session of the 17th Hai Duong Provincial People's Council, which took place from July 12-13, the Provincial People's Committee submitted to the Provincial People's Council for consideration and promulgation a resolution stipulating the allocation of funds to ensure the work of drafting legal documents, perfecting the legal system and some contents and spending levels of a specific nature in the work of inspecting, handling, reviewing and systematizing legal documents in Hai Duong province.

According to the proposal, for newly issued or replaced documents: Resolution of the Provincial People's Council: 30 million VND/draft, District level: 15 million VND/draft, Commune level: 10 million VND/draft; Decision of the Provincial People's Committee: 20 million VND/draft, District level: 10 million VND/draft, Commune level: 8 million VND/draft.

For documents amending and supplementing a number of articles: Resolution of the Provincial People's Council: 24 million VND/draft, district level: 12 million VND/draft, commune level: 8 million VND/draft; decision of the Provincial People's Committee: 16 million VND/draft, district level: 8 million VND/draft, commune level: 6.4 million VND/draft.

The budget for the appraisal and examination of proposals for drafting legal documents and draft legal documents (including meeting expenses, comments, reports and other work related to the appraisal) is included in the allocation norms for each type of legal document mentioned above as follows: The budget for appraisal of proposals for drafting resolutions of the Provincial People's Council is 3.7 million VND/document. The budget for appraisal and examination of draft legal documents for newly issued or replaced draft resolutions of the Provincial People's Council is 2 million VND/draft; the budget for draft resolutions of the Provincial People's Council amended and supplemented is 1.5 million VND/draft.

The cost of appraisal and examination of draft legal documents for newly issued or replaced draft decisions of the Provincial People's Committee is 2 million VND/draft; the cost of revised and supplemented draft decisions of the Provincial People's Committee is 1.5 million VND/draft.

Funding for appraisal and examination of draft legal documents for district- and commune-level draft legal documents: The head of the drafting agency decides on the funding level for appraisal and examination within the specific allocation rate for each type of legal document prescribed, but not exceeding VND 1.5 million/draft for newly issued or replaced draft legal documents; not exceeding VND 1 million/draft for draft amended or supplemented legal documents.

In case the agency reviewing legal documents is eligible for funding for reviewing draft legal documents prescribed in different documents at different levels, it will only receive the highest level.

Hai Duong Provincial People's Committee also proposed to prescribe specific content and expenditure levels for the work of inspecting, processing, reviewing, and systematizing legal documents.

If approved by the 16th Session of the 17th Hai Duong Provincial People's Council, the resolution will take effect from August 1, 2023.
