Since August 20, the Regulation on preferential land regime for socialized investment projects in the fields of education, vocational training, healthcare, culture, sports and environment in urban areas in the province has taken effect, opening up new opportunities for private schools in Hai Duong.
According to Mr. Nguyen Trong Tien, Deputy Director of Hai Duong Provincial Tax Department, This is a necessary and timely incentive policy with significant incentives for investors. According to regulations, the provincial People's Committee, based on the actual conditions of the locality, prescribes the land rent exemption and reduction regime for each area and sector. The maximum level is land rent exemption for the entire duration of the project, the minimum level is equal to the incentive level according to the provisions of the law on land and the law on investment. After reviewing the current situation, the People's Committee of Hai Duong province has decided to exempt land rent at the maximum level.
“This preferential policy is based on the State’s regulations and the actual conditions of the province, and will contribute to promoting the attraction of socialized investment. At the same time, it will complete the legal corridor for tax authorities to exempt land rent for investors implementing socialized projects in urban areas in the province,” said Mr. Nguyen Trong Tien.
Currently, Hai Duong has 63 private schools with 22,037 students, accounting for about 4.6% of preschool and general education students in the province, of which the most are at the preschool level (46 schools).
According to the report after monitoring some private schools of the Provincial People's Council's Culture and Society Committee and the assessment of the Hai Duong Department of Education and Training, the facilities of the education and vocational training system from the province to the grassroots level still have many difficulties and do not meet the needs. Some private high schools do not have enough subject rooms and learning support rooms as prescribed. Some schools have to rent headquarters, with limited space such as Chu Van An High School (Hai Duong City), Vu Ngoc Phan High School (Binh Giang). Some other schools lack outdoor playgrounds, do not ensure traffic safety, food hygiene, fire prevention, fire fighting, school safety... Most of the schools at all levels do not meet national standards. Meanwhile, basic equipment is still lacking compared to the requirements of the 2018 general education program...
The province's preferential policies will facilitate investors while opening up opportunities for private schools.

Sao Mai Kindergarten and Primary School (Hai Duong City) is the first case to be exempted from land rent according to the regulations of the Provincial People's Committee. This school is exempted from land rent for 50 years with an area of nearly 6,000 m2, the total exempted amount is nearly 27 billion VND.
Ms. Pham Thi Tuyet, Principal of Sao Mai Kindergarten and Primary School, shared that she was moved to tears when she saw the decision of the Provincial People's Committee on land incentives for education. "After many years of waiting, the province has finally issued a preferential policy on land for education, opening up opportunities for private schools, which makes us very grateful," Ms. Tuyet shared at the monitoring session of the Provincial People's Council's Culture and Social Affairs Committee.
The investor of Hoa Thuy Tien Kindergarten in Cam Giang district has also wanted to invest in another private school for a long time but has not found a site yet. A representative of Hoa Thuy Tien Kindergarten said that investing in a school does not require a high-rise building on a main road but requires a large area of land and open space. Therefore, even though investors have capital, they still have difficulty finding a site. Now that the province has this preferential decision, it will open up opportunities for investors.
Implementing the decision of the Provincial People's Committee, the Department of Planning and Investment of Hai Duong is presiding over the consultation with the Provincial People's Committee to approve and announce the list of socialized investment projects suitable to the actual conditions of the province in each period to attract and call for investment. At the same time, together with departments, branches and localities, it appraises, synthesizes and submits to the Provincial People's Committee for decision on approving investment policies and adjusting investment policies for socialized investment projects outside industrial parks. On October 18, the Department of Planning and Investment submitted a proposal to the province to temporarily suspend and limit investment attraction for many textile and dyeing projects, leather production, minerals, wharfs, etc. and attract investment in 46 socialized projects (including 7 projects in the field of education).
According to the Department of Education and Training of Hai Duong, in the period of 2021-2025, 6/12 districts have arranged new land funds to attract more investors to establish private high schools, reduce the burden on public schools and meet the demand when the number of high school students increases. In the 4 localities that do not have private high schools, namely Chi Linh City and Thanh Ha, Gia Loc, and Cam Giang districts, Only Gia Loc and Thanh Ha have not yet allocated land for education.
According to the decision of the People's Committee of Hai Duong province, investors implementing socialized investment projects in urban areas in Hai Duong province are leased land by the People's Committee of the province that has completed site clearance and are exempted from land rent for the entire lease term according to the project's operational period approved by the People's Committee of the province. In case the project is permitted by a competent state agency to extend the land lease term, it will not enjoy land incentives under this regulation for the extended land lease term. In case the provincial budget is not able to balance to hand over the clean site, the investor will advance the cost, and the handling of compensation and site clearance will be carried out according to regulations.
