Minister Pham Thi Thanh Tra said the amendment of the Law took place at a historic moment, with profound political, social and legal significance, closely linked to the revolution in streamlining the State apparatus.
On February 14, at the 9th Extraordinary Session, the National Assembly discussed in the hall the draft Law on Government Organization (amended) - one of four draft laws prioritized for consideration and approval to serve the work of arranging and streamlining the State administrative apparatus.
At the meeting, Minister of Home Affairs Pham Thi Thanh Tra spoke to explain and clarify many important issues, expressing her determination to complete the draft Law to submit to the National Assembly for approval at this meeting.
Thanking the delegates for their enthusiastic, responsible, dedicated, accurate and practical comments in the group and in the hall, Ms. Tra affirmed that the Ministry of Home Affairs will closely coordinate with the National Assembly's Law Committee to fully absorb and explain the comments before the National Assembly votes to approve.
Emphasizing the importance of the Law on Government Organization (amended) as a fundamental law of the State administration, the Minister of Home Affairs said that the amendment of the law took place at a historical moment, with profound political, social and legal significance, associated with the revolution in streamlining the organizational apparatus of the political system, improving efficiency, effectiveness and efficiency while removing institutional bottlenecks to unleash all resources for national development.
Minister Pham Thi Thanh Tra pointed out that the principles of this Law are "new and comprehensive" with a completely new mindset on building Vietnam's legislative system. Following the direction of the Politburo, the General Secretary and the National Assembly Chairman, the Law will only regulate issues of general principles, ensuring the value and vitality of the Law project while meeting the requirements of State management, creation and development.
The principles of law-making also closely follow the Party's policy and the Constitution on the division of authority, implementing the relationship between the Government and central agencies and local authorities, overcoming the situation of overlap, ensuring the position, role and function of the Government as the highest State administrative agency, exercising executive power and being the executive body of the National Assembly.
The breakthrough point in this amendment is to perfect the principles of decentralization, delegation, and authorization according to the Constitution and the Party's policies, creating initiative and creativity, promoting the spirit of autonomy, self-responsibility, dynamism, and creativity of the State administrative system, especially local governments. In addition, the Law will create an important legal corridor to remove barriers to decentralization, delegation of power, and assignment of specific tasks existing in specialized laws.
Minister Pham Thi Thanh Tra cited the survey results on the implementation of decentralization and delegation of power, which showed many difficulties due to specialized laws clearly defining the authority, tasks and powers of ministers. Specifically, reviewing 257 laws, there were 177 laws defining the authority of ministers and heads of ministerial-level agencies; 152 laws defining the authority of the Prime Minister; 141 laws defining very specifically the authority of the People's Council and People's Committee; and 92 laws defining the authority of all levels of government. This makes it difficult to implement the principles of decentralization, delegation and delegation.
Therefore, the Law on Government Organization (amended) will provide a principle in the organization and operation of the Government, requiring all specialized laws to comply with the principles of decentralization, delegation of authority and authorization when drafting legal documents.
"This is the most important and core issue," Minister Tra emphasized.
The legalization of legislative delegation measures to resolve current problems in specialized laws is considered by Minister Tra to be a "breakthrough thinking" and a "wise decision" of the National Assembly in a special historical condition. Without this measure, resolving hundreds of specialized laws that are being decentralized and specifically delegated will be impossible. In particular, Article 32 of the draft Law stipulates the transitional provisions, which is considered a "very new, interesting and unique" issue to resolve historical issues, creating conditions for the country to take off and enter a new era.
Minister Tra said that he will fully absorb the delegates' comments to continue perfecting the draft Law, and at the same time discuss, share and explain a number of issues of concern, such as the principles of organizing the Government's activities, defining the authority, tasks, powers and responsibilities of the Government, the Prime Minister, Ministers, Heads of ministerial-level agencies, etc.
