Partially authorize the district level to establish a council to appraise land prices and starting prices.

Regarding land valuation and land price decisions under authority, following the direction of the Government in Resolution No. 73/NQ-CP dated May 6, 2023, Vice Chairman of the City People's Committee Nguyen Trong Dong requested the Director of the Department of Natural Resources and Environment to focus on directing land valuation work; review and advise the City People's Committee to consider and decide on specific land prices as the basis for calculating land use fees and land rents, ensuring procedures, compliance with legal regulations and not causing difficulties, delays, or affecting the progress of investment project implementation.

The Hanoi City People's Committee assigned the City Inspectorate to urgently complete the conclusion of the inspection of the responsibilities of agencies in the delay in calculating land use fees and land rents; and proposed the Chairman of the City People's Committee to consider and direct before November 30, 2023.

Departments and branches: Finance, Construction, Justice, Planning - Architecture; City Tax Department proactively review and closely coordinate in land valuation to speed up the progress of specific land valuation in the area.

Under the direction of the Hanoi People's Committee, the Chairmen of the People's Committees of districts, towns and cities focus on directing land valuation and deciding on land prices according to the contents authorized by the City People's Committee in Decision No. 3475/QD-UBND dated July 4, 2023 and Decision No. 4950/QD-UBND dated September 29, 2023.

Regarding the implementation of administrative procedures in granting certificates of land use rights, house ownership rights and assets attached to land, and changing land use purposes for organizations and people, the city requests the Director of the Department of Natural Resources and Environment and the Chairmen of the People's Committees of districts and towns to continue to tighten discipline and order in direction and administration, raise the sense of responsibility of officials and civil servants, promote the responsibility of leaders, proactively and actively resolve work within their authority. At the same time, localities promptly overcome and handle the situation of avoidance, shirking, and fear of responsibility in handling work; ensure quick and timely resolution of administrative procedures for organizations and individuals.

The City assigned the Inspection Team to inspect administrative procedure control activities, conduct thematic inspections of the issuance of land use right certificates, house ownership rights and other assets attached to land (for the first time) in districts, towns and cities; point out units that avoid, shirk responsibility, are afraid of responsibility, delay in handling administrative procedure records, causing difficulties for people, agencies and organizations; prioritize surprise inspections when there are feedback and recommendations.

The Hanoi Department of Natural Resources and Environment regularly reviews and evaluates the results of implementing land use targets allocated by the Prime Minister; advises and proposes land use needs to ensure effective and economical land exploitation and use in accordance with regulations; and does not cause waste of land resources. On the other hand, the Department urgently presides over and coordinates with relevant units to review and implement the contents as requested by the Ministry of Natural Resources and Environment in Documents No. 8141/BTNMT-QHPTQD dated September 25, 2023, 8523/BTNMT-QHPTQD dated October 5, 2023, and the draft Document of the Hanoi People's Committee reporting to the Ministry of Natural Resources and Environment.

Previously, to speed up the implementation progress, strive to complete the land use rights auction plan in 2023, and create resources for socio-economic development, the Hanoi People's Committee authorized the district-level People's Committee to decide to establish a specific land price appraisal council and decide the starting price for land use rights auction in cases where the auctioned land has a value (calculated according to the land price in the Land Price List) of 30 billion VND or more to allocate land with land use fees to households and individuals in Hanoi. The authorization period is from July 4, 2023 to June 30, 2025.

The District People's Committee is responsible before the law and the City People's Committee within the scope of its authorized rights and tasks; it is not allowed to re-authorize other organizations or individuals to perform the authorized rights and tasks. During the implementation process, if any problems arise beyond its authority, the District People's Committee will synthesize and report to the City for consideration and resolution in accordance with the provisions of law; at the same time, ensure financial conditions, human resources and other necessary conditions to perform the authorized tasks...

The Hanoi People's Committee continues to authorize the district-level People's Committee to decide to increase the land price adjustment coefficient as a basis for determining the starting price for land use rights auctions to allocate land with land use fees or lease land in cases where the land plot or land area for auction has a value (calculated according to the land price in the Land Price List) of less than 30 billion VND in urban areas, traffic hubs, and concentrated residential areas with advantages and profitability.

The authorization period is from February 1, 2025 to June 30, 2025. Before June 1, 2025, the Department of Finance shall preside over and coordinate with departments, branches, People's Committees of districts, towns and cities to organize a preliminary review and assessment of the results of the authorization work, and report to the City People's Committee for consideration of continued authorization as a basis for implementation in the following period.

Also following the direction of the City People's Committee, from September 18, 2023, Hanoi will implement Decision No. 20/2023/QD-UBND, amending, supplementing and adjusting Decision No. 30/2019/QD-UBND dated December 31, 2019 of the Hanoi People's Committee on promulgating regulations and price lists of land types in the city (applicable from January 1, 2020 to December 31, 2024).

This new Decision amends Clause 1, Article 1, Decision No. 30/2019/QD-UBND. Specifically: The land price list is used as a basis for calculating land use fees when the State recognizes the right to use residential land of households and individuals for the area within the limit; allows the change of land use purpose from agricultural land, non-agricultural land that is not residential land to residential land for the area within the limit of land allocation for households and individuals; calculates land use tax; calculates fees and charges in land management and use; calculates fines for administrative violations in the land sector; calculates compensation to the State for causing damage in land management and use; Calculate the value of land use rights to pay for people who voluntarily return land to the State in cases where the returned land is land allocated by the State with land use fees collected, recognized land use rights with land use fees collected, or leased land with one-time land rent payment for the entire lease term.
