The People's Committee at district level will be authorized to decide on land prices in cases such as calculating compensation, collecting land use fees when allocating resettlement land, and calculating land rent.
The Government has just issued Resolution No. 73/NQ-CP on the authorization to decide on specific land prices.
The Resolution clearly states that the People's Committees of provinces and centrally run cities, based on the provisions of the Law on Organization of Local Government, Conclusion No. 14-KL/TW dated September 22, 2021 of the Politburo and the actual situation of the locality, shall authorize the People's Committees at the district level to decide on specific land prices to calculate compensation when the State recovers land; collect land use fees when allocating resettlement land; calculate land use fees and land rents when the State allocates land, leases land, or changes land use purposes to households and individuals; determine land prices for areas exceeding the limit when the State recognizes the right to use residential land for households and individuals; determine starting prices for auctioning land use rights for households and individuals.
The People's Committee at the district level is authorized to decide to establish a Land Valuation Council, with members of the Council including: Chairman of the People's Committee at the district level as Chairman of the Council; leaders of the district-level financial agency as standing member of the Council; leaders of the natural resources and environment agency, relevant district-level professional agencies and leaders of the People's Committee at the commune level where the land is located; organizations with the function of consulting on land valuation or land price experts and other members decided by the People's Committee at the district level. The Department of Natural Resources and Environment at the district level assists the People's Committee at the district level in organizing land valuation.
The Resolution also requires the People's Committees of provinces and centrally run cities to ensure financial conditions, human resources and other necessary conditions for the People's Committees at the district level to decide on specific land prices as authorized under the above provisions; guide and inspect the implementation of delegated tasks and powers, and be responsible for the results of the implementation of the tasks and powers they have delegated; strengthen inspection, supervision and control of power, combat negativity, corruption, waste and abuse of policies for personal gain.
This Resolution takes effect from the date of signing and promulgation (May 6, 2023) and is implemented until the Land Law (amended) is passed by the National Assembly to replace the 2013 Land Law that comes into effect.
