Can a 7 year old child returning from abroad go to primary school?

Question: My 7-year-old nephew came back from abroad and wants to apply to attend primary school in Vietnam. Can he enter first grade like 6-year-olds?

Article 33 of Circular 28/2020/TT-BGDDT dated September 4, 2020 promulgating the Primary School Charter stipulates the age for primary school admission as follows:

The age of students entering first grade is 6 years old and is calculated by year. Cases that can enter first grade at an age higher than the regulation but not more than 3 years old include:

- Children with disabilities, physical or mental retardation,

- Children in areas with particularly difficult socio-economic conditions,

- Ethnic minority children,

- Orphans with no place to go,

- Children returning home from abroad,

- Children of foreigners studying and working in Vietnam.

In case children enter first grade 3 years older than the regulation, the head of the Department of Education and Training will decide.

According to regulations, your child is 7 years old, older than the age to enter first grade, but because he is a child returning from abroad, he can still enter first grade like 6-year-olds after completing the required procedures.
