What is the penalty for not passing a breathalyzer test?

For motorbikes:Pursuant to the provisions of Point g, Clause 8 and Point g, Clause 10, Article 6 of Decree 100/2019/ND-CP:

Penalties for drivers and passengers of motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles who violate road traffic regulations. Fines of VND 6-8 million shall be imposed on drivers who do not comply with the request of an officer on duty to check their alcohol concentration.

In addition, the driver will also have his/her driving license revoked for 22-24 months. Therefore, a motorcyclist who does not comply with the traffic police's request to check for alcohol concentration can be fined up to 8 million VND. At the same time, his/her driving license will be revoked for 22-24 months.

For cars:Clause 10, Article 5 of Decree 100/2019/ND-CP imposes a fine of 30-40 million VND on drivers of cars and similar vehicles who commit one of the following violations:

- Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath.

- Failure to comply with the request for alcohol concentration testing by an officer on duty.

- Driving on the road while having drugs in the body.

- Failure to comply with the request of a law enforcement officer for drug testing. In addition to being fined, the driver who commits the violation will also be subject to additional penalties such as having his/her driver's license revoked for 22-24 months.

Accordingly, drivers who do not comply with the request of an officer to check their alcohol level will be fined 30-40 million VND. In addition, the driver will have his/her driving license revoked for 22-24 months.

For tractors, specialized vehicles:Pursuant to Point b, Clause 9 and Point e, Clause 10, Article 7 of Decree 100/2019/ND-CP stipulating the fine for drivers of tractors and specialized motorbikes who do not comply with the request for alcohol concentration testing by officials on duty.

Fines of 16-18 million VND for drivers who do not comply with requests for alcohol concentration testing by law enforcement officers.

In addition to being fined, the driver who commits the violation will also have his/her driving license and certificate of training in road traffic law revoked for 22-24 months.

Thus, if a tractor or specialized motorbike driver fails to comply with the alcohol concentration test request, he/she will be fined 16-18 million VND and have his/her driving license revoked for 22-24 months.

In case of passing or avoiding alcohol concentration checkpoints, depending on the actual situation, motorbike drivers can be fined up to 8 million VND, while the fine for cars is up to 40 million VND, and for tractors, the maximum is 18 million VND.
