Question: During the restructuring of the apparatus, many cadres, civil servants, public employees and workers at state agencies will be considered for layoffs.
I think this is an important step to streamline the apparatus and improve the efficiency of the system. However, I wonder if there are any subjects that will not be considered for resignation?

Reply:From January 1, 2025, Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system will take effect.
Accordingly, this Decree applies to:
Firstly, cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, units, and armed forces due to the arrangement of organizational apparatus and administrative units at all levels, including:
- Cadres, civil servants, leaders, managers and civil servants.
- Commune-level officials and civil servants.
- People working under labor contracts according to the provisions of labor law before January 15, 2019 and people working under labor contracts are subject to the same policies as civil servants.
- Officers, professional soldiers, workers and defense officials of the Vietnam People's Army.
- Officers, non-commissioned officers receiving salaries, police workers and contract workers receiving salaries from the state budget of the People's Public Security.
- People working in key organizations.
Second, cadres who do not meet the age requirements for re-election or re-appointment to positions and titles according to their terms in agencies of the Communist Party of Vietnam, the State, socio-political organizations, and cadres who resign at will shall comply with the provisions of other decrees of the Government.
However, according to Article 4 of Decree 178, cases that have not been considered for resignation in this restructuring round include:
- The subjects specified in the first case above are women who are pregnant, on maternity leave, or raising children under 36 months old, except in cases where individuals voluntarily quit their jobs.
- Those who are under disciplinary review or criminal prosecution or are being inspected or examined due to signs of violations.
